The Sixth Amendment guarantees a right to a public and speedy jury trial with witnesses, the right to confront the accusers and the right to legal counsel.\u00a0\u00a0And the Eighth Amendment guarantees a right to bail.\u00a0\u00a0\u00a0And yet, these \u201ccriminal aliens\u201d don\u2019t get any of these rights when it\u00a0\u00a0comes to ICE.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Undocumented<\/h2>\n\n\n\n<p class=\"\">The American Civil Liberties Union defines being \u201cundocumented\u201d this way:<\/p>\n\n\n\n<p class=\"\"><em>The act of being present in the United States in violation of the immigration laws is not, standing alone, a crime. While federal immigration law does criminalize some actions that may be related to undocumented presence in the United States, undocumented presence alone is not a violation of federal criminal law. (<a href=\"https:\/\/www.aclu.org\/sites\/default\/files\/field_document\/FINAL_criminalizing_undocumented_immigrants_issue_brief_PUBLIC_VERSION.pdf\">ACLU<\/a>)<\/em><\/p>\n\n\n\n<p class=\"\">A good example of this is someone who comes to the United States on a tourist visa.\u00a0\u00a0They enter the country legally, but if they fail to return home within the visa limitations, then they remain in the country without permission.\u00a0\u00a0They are undocumented, not criminal.<\/p>\n\n\n\n<p class=\"\">There ARE undocumented folks who commit \u201creal\u201d crimes.\u00a0\u00a0Many of them are in jail right now. (<em>The conservative <a href=\"https:\/\/www.cato.org\/policy-analysis\/illegal-immigrant-incarceration-rates-2010-2023#:~:text=According%20to%20a%20Cato%20Institute%20policy%20analysis%2C,between%2065%25%20and%2075%25%20below%20native%2Dborn%20Americans\">Cato Institute<\/a>\u00a0estimates that there are nearly 70,000 undocumented persons in US Prisons.\u00a0\u00a0There are 1.25 million total prisoners in the US, so around 5% are undocumented, about the same percentage as the total number of undocumented in the population).\u00a0\u00a0<\/em>And, many of them are removed from the United States after serving their prison sentence, here.<\/p>\n\n\n\n<p class=\"\">ICE recognizes that \u201cdocumentation\u201d is not, in itself, a crime. It\u2019s a \u201ccivil\u201d offense, similar to traffic laws on a local level.\u00a0\u00a0And they take advantage of that fact, by using \u201cadministrative procedures\u201d.\u00a0\u00a0Most of the time, if you get a traffic ticket, you pay the fine and go about your life.\u00a0\u00a0More serious offenses might require a court hearing, and perhaps suspension of driving privileges. But, unless you commit multiple serious offenses (driving under the influence, vehicular homicide) you aren\u2019t in jeopardy of arrest and jail. A similar \u201ccivil law\u201d status gives ICE  the powers to hold and remove the undocumented from the United States with little judicial intervention.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Labels<\/h2>\n\n\n\n<p class=\"\">The reality is that the vast majority of undocumented folks in the United States have NOT committed a crime.\u00a0\u00a0Labelling them \u201ccriminals\u201d is legally incorrect.\u00a0\u00a0It\u2019s a political gambit, to stoke fear and justify the draconian measures of Stephen Miller and his \u201cprivate\u201d army, ICE.\u00a0\u00a0But, let\u2019s give them what they\u2019re asking for.\u00a0\u00a0Let\u2019s make being undocumented \u201ccriminal\u201d.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">That ends ICE \u201crenditions\u201d out of state to more \u201cfavorable\u201d areas.\u00a0\u00a0Midnight flights to Louisiana and Texas violate due process rights.\u00a0\u00a0And, those \u201carrested\u201d for being undocumented ought to have the same bail rights as any other \u201ccriminal\u201d,  and all those Sixth Amendment rights, including the right to counsel.\u00a0\u00a0None of those things are happening now.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">The Supreme Court ruled in\u00a0<em>Yick Wo v Hopkins\u00a0<\/em>(US 118 356, 1886) that EVERYONE in the United States; citizens, documented non-citizens, and undocumented non-citizens, have the right to due process of law including Constitutional rights.\u00a0\u00a0\u00a0It\u2019s old, established, Constitutional law.\u00a0\u00a0Stephen Miller and ICE are circumventing those rights by treating the \u201cundocumented\u201d as \u201cpaperwork\u201d issues.\u00a0\u00a0But the resulting penalties; seizure, imprisonment without bail in far away and remote locations, no counsel or judicial proceedings, and deportation from the country, are far beyond what even the real criminals are receiving for their crimes.\u00a0\u00a0It\u2019s not just a ticket, and it\u2019s not just \u201cpaperwork\u201d when a five-year old with a bunny hat from Minneapolis ends up in Federal \u201ccustody\u201d in Texas.<\/p>\n\n\n\n<p class=\"\">Let\u2019s call it out.\u00a0\u00a0Either criminalize the undocumented, and give them their legal rights, or get ICE off the streets, and leave the undocumented alone.\u00a0\u00a0Maybe ICE could do what we actually pay them to do:\u00a0\u00a0find those dangerous criminals who happen to be undocumented, and use the \u201cpaperwork\u201d to get them out of the country, fast.\u00a0<\/p>\n\n\n\n<p class=\"\">\u00a0They&#8217;re probably not the ones wearing bunny hats.<\/p>\n\n\n\n<p class=\"\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Constitutional Rights I listened to\u00a0\u00a0House of Representatives committee examine the Director of ICE yesterday.\u00a0\u00a0What struck me was this.\u00a0\u00a0Republicans consistently used the phrase \u201ccriminal aliens\u201d to identify those who are in the United States without proper documentation.\u00a0\u00a0So here\u2019s my question.\u00a0\u00a0If those folks are actual \u201ccriminals\u201d, then shouldn\u2019t they get the \u201ccriminal rights\u201d that the United States &hellip; <a href=\"https:\/\/dahlman.online\/index.php\/2026\/02\/11\/both-ways\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Both Ways&#8221;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","om_disable_all_campaigns":false,"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[1],"tags":[],"class_list":["post-8404","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
