{"id":8003,"date":"2025-07-24T09:56:31","date_gmt":"2025-07-24T13:56:31","guid":{"rendered":"https:\/\/dahlman.online\/?p=8003"},"modified":"2025-07-24T09:56:33","modified_gmt":"2025-07-24T13:56:33","slug":"promises-broken","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2025\/07\/24\/promises-broken\/","title":{"rendered":"Promises Broken"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Sit on the Files<\/h2>\n\n\n\n<p class=\"\">I wrote an essay the other day about the Trump Administration\u2019s efforts to distract from the Epstein \u201ccrisis\u201d (<em><a href=\"https:\/\/dahlman.online\/index.php\/2025\/07\/22\/disturbance-in-the-force\/\">Disturbance in the Force<\/a>).\u00a0<\/em>\u00a0There\u2019s not a whole lot more to say about the \u201cmeat\u201d of the issue, other than a\u00a0<em>Wall Street Journal\u00a0<\/em>article that Attorney General Pam Bondi notified President Trump that his name was in the \u201cEpstein Files\u201d.\u00a0\u00a0Soon after; Bondi, FBI Director Patel, and FBI Deputy Director and noted conspiracy theorist Dan Bongino issued a two page memo.\u00a0\u00a0They said there was nothing to release.\u00a0\u00a0That report lit MAGA-world on fire, a fire that has yet to be controlled.\u00a0\u00a0The \u201cEpstein Files\u201d story, as the newspaper\u2019s would say, \u201chas legs\u201d.<\/p>\n\n\n\n<p class=\"\">Everyone in MAGA-world got dragged into this.\u00a0\u00a0Speaker Mike Johnson literally sent the House of Representatives home, rather than have votes on releasing the files.\u00a0\u00a0And when a reporter asked Johnson if he was \u201cafraid\u201d of the Epstein issue, Johnson forcefully responded, and deflected.\u00a0\u00a0He claimed that this was all the Biden Administration\u2019s fault.\u00a0\u00a0He said they had the information and \u201csat on it\u201d, and Johnson wasn\u2019t going to get mired in \u201ctheir\u201d mistake.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mid-Year Exam<\/h2>\n\n\n\n<p class=\"\">So let\u2019s look at what the Department of Justice (DOJ) does, and the recent history of \u201ccontroversial\u201d cases.\u00a0\u00a0The \u201ctraditional\u201d job of Justice, is to investigate and prosecute.\u00a0\u00a0For generations, the Department did NOT \u201ctalk\u201d about cases.\u00a0\u00a0As we learned through the Mueller and later Jack Smith; the traditional DOJ \u201cspeaks\u201d through indictments and charges filed in Court. In fact, there\u2019s a term for that:\u00a0\u00a0a \u201cspeaking indictment\u201d.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">But the current issue begins with the \u201cgreat exception\u201d to DOJ practices; made in the middle of the 2016 Presidential election campaign.\u00a0\u00a0You probably remember;\u00a0\u00a0 the \u201cBenghazi Hearings\u201d  revealed that then-Secretary of State Hillary Clinton was using a private email server.\u00a0\u00a0The controversy was: did the use of that server violate Federal Law, by avoiding public record laws, and  risking classified information on a \u201chome\u201d server.<\/p>\n\n\n\n<p class=\"\">The Trump Campaign used it against Clinton:\u00a0\u00a0where are the emails?\u00a0\u00a0And the FBI did a comprehensive investigation into the Clinton emails, code-named \u201cMid-Year Exam\u201d.\u00a0\u00a0The investigation culminated in an extended interview of Clinton herself, over the Fourth of July weekend of 2016, just weeks before the Democratic Convention.<\/p>\n\n\n\n<p class=\"\">This was during the Obama Administration, and Loretta Lynch was the Attorney General.\u00a0\u00a0That was an inherent conflict.\u00a0\u00a0While the FBI investigates crimes, they do not make decisions about charging crimes in court.\u00a0\u00a0That is the job of the prosecutors of the DOJ.\u00a0\u00a0But because of obvious politics and an apparent conflict of interest (Lynch spoke with Bill Clinton when both were on the runway of an airport), there was no clear line of authority.\u00a0\u00a0If the head of DOJ couldn\u2019t make the decision to charge Clinton or not, who would?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comey<\/h2>\n\n\n\n<p class=\"\">The FBI Director, James Comey, was a former Deputy Attorney General (in the George Bush Administration), and a career prosecutor.\u00a0\u00a0After looking at the investigation\u2019s results, he determined that Clinton did not \u201cshow an intent\u201d to violate the laws, a critical factor in bringing criminal charges.\u00a0\u00a0And he took it upon himself to determine that no charges would be filed.<\/p>\n\n\n\n<p class=\"\">But he went farther than that.\u00a0\u00a0DOJ policy says when an investigation is concluded, and no charges are going to be made, that any announcement is limited to saying, \u201cno charges will be filed\u201d.\u00a0\u00a0But Comey felt the need to go into great detail to explain, that while Clinton didn\u2019t commit a criminal offense, she was careless with classified information.\u00a0\u00a0So while she wasn\u2019t charged, she was \u201cconvicted\u201d in the world of public opinion.<\/p>\n\n\n\n<p class=\"\">No one was satisfied with Comey\u2019s actions.\u00a0\u00a0Democrats pointed to DOJ policy.\u00a0\u00a0Republicans pointed to Comey\u2019s \u201ccareless\u201d statement.\u00a0\u00a0And, later, when further investigation was required, Comey announced that the investigation was re-opened, days before the Presidential election.\u00a0\u00a0Many, including this author, believe that Comey\u2019s announcement cost Clinton the Presidency (and the United States the Trump Presidencies).<\/p>\n\n\n\n<p class=\"\">What did the Department of Justice learn from all of that?\u00a0\u00a0Mueller, Jack Smith, and even John Durham let their indictments and final reports speak for their investigations.\u00a0\u00a0That continued into the Biden Administration, where Attorney General Merrick Garland required a strict adherence to DOJ policies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nothing to See<\/h2>\n\n\n\n<p class=\"\">Back to Epstein:\u00a0\u00a0he was arrested and charged (and died) under the first Trump Administration.\u00a0\u00a0When Garland took charge, there were no charges to be made, Epstein was dead.\u00a0\u00a0But there were charges filed, and a conviction gained, against Ghislane Maxwell, Epstein\u2019s procurer.\u00a0\u00a0She\u2019s serving twenty years in Federal prison.\u00a0\u00a0The indictments and the conviction \u201cspoke\u201d for the DOJ.<\/p>\n\n\n\n<p class=\"\">And that policy was used by conspiracy theorists to attack Biden and later Kamala Harris.\u00a0\u00a0They \u201cmust be hiding\u201d the Epstein \u201cblack book\u201d:  the list of all the participants in his child sex parties and tours.\u00a0\u00a0(While whoever is on that list may well have committed crimes, the statute of limitations for those crimes has likely run out).\u00a0\u00a0But the Garland DOJ had nothing to say:  no charges, no statements.<\/p>\n\n\n\n<p class=\"\">So when Trump won the election, many conspiracy theorists were excited.\u00a0\u00a0Finally the \u201ctheorists\u201d were in charge:\u00a0\u00a0Patel and Bongino at the FBI and Bondi leading the DOJ.\u00a0\u00a0\u00a0But now:\u00a0\u00a0\u201cThere\u2019s nothing to see here, move along, move along\u201d.\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">Unlike Star Wars, no one is moving along.<\/p>\n\n\n\n<p class=\"\">Merrick Garland followed the policy of the DOJ \u2013 no charges, no further statements.\u00a0\u00a0Now Pam Bondi is trying to do the same.\u00a0\u00a0The problem is \u2013 she \u201cpromised\u201d the \u201cEpstein Files\u201d, over and over and over and over
