{"id":7741,"date":"2025-03-17T10:27:23","date_gmt":"2025-03-17T14:27:23","guid":{"rendered":"https:\/\/dahlman.online\/?p=7741"},"modified":"2025-03-17T10:27:25","modified_gmt":"2025-03-17T14:27:25","slug":"in-peril","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2025\/03\/17\/in-peril\/","title":{"rendered":"In Peril"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Balance of Power<\/h3>\n\n\n\n<p class=\"\">Back in \u201cthe day\u201d, I taught my classes about the \u201cchecks and balances\u201d in the US Constitution.\u00a0 \u00a0We discussed which branch; the Congress, the President, or the Courts, had the most power.\u00a0\u00a0And we talked about the practical power of the President.\u00a0\u00a0There is a single \u201cmind\u201d to determine what actions to take, versus the Congress, where at least half of the House and half of the Senate, 267 total legislators, must agree to move forward.\u00a0\u00a0What Congress does have is the power of the \u201cpurse\u201d.\u00a0\u00a0They control how government money is spent.\u00a0\u00a0As long as they have majorities, they can act.\u00a0\u00a0The Executive might do anything, but if Congress won\u2019t pay for it, then it won\u2019t happen.<\/p>\n\n\n\n<p class=\"\">The \u201dpower of the purse\u201d still exists.\u00a0 \u00a0Congress can determine what money the government spends, and, through established law, how it is spent.\u00a0\u00a0So it\u2019s not like the Trump Administration, with their massive cuts and firings, is operating in a vacuum.\u00a0\u00a0The United States Congress is tacitly agreeing with DOGE; the cuts, the firings, and the altered spending plans.\u00a0\u00a0Congress isn\u2019t standing up for the \u201cpower of the purse\u201d, they willingly\u00a0\u00a0are giving it to the President.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Powerless&nbsp;<\/h3>\n\n\n\n<p class=\"\">Why is Congress abandoning its main source of power?\u00a0\u00a0First, the operating majority of both Houses of Congress are committed to the ideals of Project 2025, the \u201cdisestablishment of the administrative state\u201d.\u00a0 \u00a0They are willing to allow extra-legal means, seemingly rogue actions by the Administration in violation of existing law, in order to rapidly achieve the goals of the 900 page report. (<em>That\u2019s the same report that candidate Trump didn\u2019t know much about).\u00a0<\/em><\/p>\n\n\n\n<p class=\"\">Second, they are driven by fear; fear of being targets of Donald Trump.\u00a0\u00a0 \u00a0I made a most disheartening discovery in the last fifteen years.\u00a0\u00a0I thought that the leaders I disagreed with were still honorable with the best interest of the Nation at heart.\u00a0\u00a0They really aren\u2019t.\u00a0\u00a0They are driven by simple political survival,\u00a0\u00a0and are doing whatever is required to stay in office.\u00a0\u00a0(Not all; Ohio\u2019s Rob Portman is a great example of a Republican politician who \u201cchose not to play\u201d.  He retired from the Senate).\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Speedbump<\/h3>\n\n\n\n<p class=\"\">And third, many are driven by simple cash.\u00a0 \u00a0Not bribery necessarily, but the reality of modern campaigning.\u00a0\u00a0The average winning House campaign cost $2 million in the 2020 election cycle (<a href=\"https:\/\/goodparty.org\/blog\/article\/how-much-cost-run-for-office\">Good Party<\/a>).\u00a0\u00a0Senate campaigns are much, much more.\u00a0\u00a0Sherrod Brown, Ohio\u2019s former Senator, spent over $100 million campaigning over his last term in office. And he lost.\u00a0\u00a0When Elon Musk offers millions either to a sitting legislator, or to their next challenger; it\u2019s a very real threat.\u00a0\u00a0The carrot is large, but the stick is even bigger.<\/p>\n\n\n\n<p class=\"\">So Congress abrogated its power to control executive actions.\u00a0\u00a0 And, frankly, the minority, my political party, hasn\u2019t even managed to \u201cget in the way\u201d.\u00a0\u00a0We aren\u2019t even a speed bump on the road to Presidential domination.\u00a0\u00a0\u00a0It\u2019s true that speed bumps regularly get run over,\u00a0\u00a0but they do slow traffic down.\u00a0\u00a0Last week, Senator Schumer determined to not even try.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Let Him Enforce It<\/h3>\n\n\n\n<p class=\"\">\u00a0As far as the Courts are concerned, my students talked about their power over the other two branches as symbolic. \u00a0\u00a0I often brought up the example of President Andrew Jackson, who determined to ignore a Supreme Court order that would have interrupted the \u201cIndian Removal\u201d (the \u201cTrail of Tears\u201d was part of that removal).\u00a0\u00a0Legendary Chief Justice John Marshall led the Court in ruling against Jackson\u2019s actions.\u00a0\u00a0But Jackson famously retorted:\u00a0\u00a0\u201cJohn Marshall made his decision, let him enforce it\u201d.\u00a0<\/p>\n\n\n\n<p class=\"\">US Courts have no \u201cenforcement arm\u201d. \u00a0\u00a0The police, the Marshals, Agents, Officers, all work for the executive branch, at the behest of the President; not the Courts.\u00a0\u00a0Andrew Jackson knew well that HE controlled the army that was marching the Cherokee to Oklahoma, not John Marshall.\u00a0\u00a0And like Donald Trump today, Jackson was totally confident that the Congress was behind him.\u00a0\u00a0Certainly the wealth in land sales that removing the Indians allowed, encouraged Congressional support .\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">So the current President of the United States ignores Court decisions, defies Court orders, and literally laughs when defying Federal judges.\u00a0\u00a0 When a judge ordered Trump\u2019s ICE to return hundreds of Venezuelans\u00a0\u00a0from being deported to El Salvador; the planes still landed, and the prisoners transferred to El Salvadoran \u201ccare\u201d.\u00a0\u00a0\u00a0Even the President of El Salvador was \u201cin\u201d on the joke, tweeting \u201coops \u2013 too late\u201d.<\/p>\n\n\n\n<p class=\"\">When another Federal Judge ordered the reinstatement of USAID funds, the Trump Administration refused. \u00a0The same MAGA-Republicans chortled when their own \u201cpet judge\u201d, Federal District Judge\u00a0Kacsmaryk\u00a0in Amarillo, Texas, stopped one Biden initiative after another.  They now claim;\u00a0&#8220;A single judge in a single city cannot dictate the movement of a plane filled with foreign terrorists who have already been physically removed from U.S. soil,&#8221;\u00a0(Trump\u2019s press secretary Karoline Leavitt).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Final Actions<\/h3>\n\n\n\n<p class=\"\">All of this will end in the US Supreme Court.\u00a0\u00a0 And nothing is sure there.\u00a0\u00a0Three of the Justices will stand for the Constitution.\u00a0\u00a0Three or four will clearly follow the President.\u00a0\u00a0The middle two or three will determine the future of our Democracy.\u00a0\u00a0And even if they rule against Trump\u2019s actions, there\u2019s no guarantee he\u2019ll obey.<\/p>\n\n\n\n<p class=\"\">If Trump doesn\u2019t follow the Court, the only recourse is back to Congress.\u00a0\u00a0 A majority of the House, and two-thirds of the Senate would have to agree to impeach and remove him.\u00a0\u00a0And that is as likely as Trump himself saying \u201cI\u2019ve gone too far\u201d.\u00a0\u00a0So what will happen to our country, our carefully balanced Constitutional Republic?\u00a0\u00a0Do we survive until the election of 2028, or even the Congressional elections of 2026?\u00a0\u00a0<\/p>\n\n\n\n<p class=\"\">When there is no balance, we are a boat listing to one side.\u00a0 \u00a0Disaster is just a single wave away.\u00a0\u00a0\u00a0We, the People of the United States, are in peril.<\/p>\n\n\n\n<p class=\"\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Balance of Power Back in \u201cthe day\u201d, I taught my classes about the \u201cchecks and balances\u201d in the US Constitution.\u00a0 \u00a0We discussed which branch; the Congress, the President, or the Courts, had the most power.\u00a0\u00a0And we talked about the practical power of the President.\u00a0\u00a0There is a single \u201cmind\u201d to determine what actions to take, versus &hellip; <a href=\"https:\/\/dahlman.online\/index.php\/2025\/03\/17\/in-peril\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;In Peril&#8221;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","om_disable_all_campaigns":false,"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[1],"tags":[],"class_list":["post-7741","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
