First Amendment to the Constitution of the United States<\/em><\/em><\/h5>\n\n\n\n

Congress shall make no law respecting an <\/em>establishment of religion<\/em>, or prohibiting the <\/em>free exercise<\/em> <\/em>thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances<\/em><\/p>\n\n\n\n

Basic Right<\/h3>\n\n\n\n

It is a basic tenet of American citizenship:\u00a0\u00a0the First Amendment.\u00a0 \u00a0We summarize it simply; we Americans have \u201cfreedom of speech\u201d.\u00a0\u00a0That\u2019s a direct quote from the Amendment by the way; \u201cCongress shall make no law\u2026abridging the freedom of speech or of the press\u2026\u201d.\u00a0\u00a0And we all have a basic understanding what that means.\u00a0\u00a0Americans can think and say our politics view, without \u201cthe government\u201d coming against us.\u00a0\u00a0We don\u2019t fear arrest for \u201cbad-speak\u201d.\u00a0\u00a0But there are limits. It often takes the entire stretch of adolescence to understand that \u201cfree speech\u201d doesn\u2019t apply when talking to your parents, or your employer. We all tried it.<\/p>\n\n\n\n

Our current understanding of the First Amendment took some figuring out.\u00a0\u00a0The second President of the United States, John Adams, lived in a time almost as politically ugly as our own.\u00a0 \u00a0I mean, his Vice President, Thomas Jefferson said of Adams:<\/p>\n\n\n\n

\u201c(He\u2019s) A blind, bald, crippled toothless man who is a hideous hermaphroditic character with neither the force and fitness of a man, not the gentleness and sensibility of a woman.<\/em>\u201d<\/p>\n\n\n\n

Of course, Adam\u2019s responded, calling Jefferson a:<\/p>\n\n\n\n

 <\/em>\u201c\u2026(M)ean-spirited, low-lived fellow, the son of a half-breed Indian squaw, sired by a Virginia mulatto father.\u201d<\/em><\/p>\n\n\n\n

\u00a0Adams and Jefferson had a conflicted relationship.\u00a0\u00a0 They were close at the writing of the Declaration in the 1770\u2019s, and would become fast pen-pals after Jefferson left office in 1808.\u00a0\u00a0But in the middle thirty years, they were arch-enemies.<\/em><\/p>\n\n\n\n

Thin Skin<\/h3>\n\n\n\n

Not to continue insulting, but Adams was notoriously thin-skinned.\u00a0\u00a0And when some of the insults came from new immigrants to the still-new United States, he did something about them.\u00a0\u00a0Adams and his Federalist Congress authored the Alien and Sedition Acts<\/em>.\u00a0\u00a0They lengthened the time it took to earn US citizenship, and they restricted the \u201cfree speech\u201d rights of those not yet citizens.\u00a0\u00a0The Sedition Act<\/em> went even farther, making it illegal for even citizens to criticize the President.\u00a0\u00a0Some newspapers publishers were jailed.<\/p>\n\n\n\n

This was all before\u00a0Marbury v Madison\u00a0<\/em>(1803),\u00a0\u00a0when the United States Supreme Court claimed the power of judicial review.\u00a0\u00a0The Sedition Act<\/em>, and most of the Alien Acts <\/em>expired before they were ever tested in Court.\u00a0Today, most scholars see that Presidential \u201cmuzzling\u201d as unconstitutional, a violation of \u201cfree speech\u201d.\u00a0\u00a0That is, except for one exception, a part of the Alien Act <\/em>which remains in our current laws.\u00a0\u00a0It is codified as\u00a050 U.S. Code \u00a7 21:\u00a0\u00a0Restraint, Regulation and Removal.<\/em><\/p>\n\n\n\n

50 US Code<\/h3>\n\n\n\n

It allows for any citizens above the age of fourteen of a foreign nation that has declared war on the United States, or incurred or invaded the US, \u201c\u2026shall be liable to be apprehended, restrained, secured, and removed as alien enemies.\u201d<\/p>\n\n\n\n

That ancient (1798) law was used to detain British citizens in the War of 1812, and German citizens during World War I. And most infamously, it was the legal structure beneath Executive Order 9066<\/em> that established Japanese\/American internment camps of World War II. (A brief reminder:\u00a0\u00a0during World War II Japanese citizens, naturalized Americans born in Japan, and\u00a0American-born citizens\u00a0<\/u>of Japanese ancestry were rounded up and put in \u201cinternment camps\u201d.\u00a0 \u00a0That action was confirmed by the 1944 US Supreme Court in Korematsu v United States<\/em>. It was only \u201crebuked\u201d by the Court in 2018 in Trump v Hawaii.<\/em>\u00a0\u00a0It has never been directly overturned.)<\/p>\n\n\n\n

Green Card<\/h3>\n\n\n\n

Which brings us literally, to the present.\u00a0\u00a0 This week, Mahmoud Khalil was arrested.\u00a0\u00a0Khalil is a graduate student at Columbia University and a Palestinian citizen.\u00a0\u00a0He is in the United States with a permanent visa, what is termed a \u201cgreen card\u201d.\u00a0\u00a0That gives him the right to stay, work, and live in the United States.\u00a0\u00a0And he planned on doing so, finishing up his graduate degree in engineering.\u00a0\u00a0He is married, and his wife is eight months pregnant (her name has not been released).\u00a0<\/p>\n\n\n\n

In general, permanent residents of the United States have most of the same \u201cFirst Amendment\u201d rights as citizens.\u00a0\u00a0The only limitations are in campaign contributions:\u00a0\u00a0only US citizens can donate to Federal political campaigns.\u00a0\u00a0But the current Trump Administration has decided to reach back to John Adam\u2019s Alien Act<\/em> to arrest Khalil for his activities in support of the Palestinians during the protests at Columbia University last year.\u00a0<\/p>\n\n\n\n

Fait d’Accompli<\/h3>\n\n\n\n

\u00a0They are correlating support for the Palestinian cause as support for the terrorist group Hamas.\u00a0\u00a0\u00a0Khalil was a spokesman for those Columbia students protesting the Israeli attacks on Gaza.\u00a0\u00a0\u00a0Trump has declared those protests \u201canti-Semitic\u201d, and ordered that non-citizen participants be rounded up and deported.\u00a0\u00a0They are now, \u201cenemy aliens\u201d.<\/p>\n\n\n\n

Khalil was arrested, then whisked from Manhattan to an ICE holding center (jail) in Louisiana, far away from his wife, lawyers, and the Federal Courts of the Southern District of New York that have jurisdiction over his case.\u00a0\u00a0 Like many of the ICE actions under Trump, it\u2019s clear that they aren\u2019t interested in dealing with the \u201clegality\u201d of Court decisions.\u00a0\u00a0If ICE can move fast enough, hiding detainees in far-away jails, then using military transports to dump them in some foreign country, they don\u2019t have to \u201cworry\u201d what the Federal Courts have to say.\u00a0\u00a0As the French that Adam\u2019s disliked so much say, it\u2019s a \u201cfait d\u2019acompli\u201d.\u00a0<\/p>\n\n\n\n

Nightmare Progression<\/h3>\n\n\n\n

Many of my \u201cprogressive\u201d friends are split over what happened in the Middle East in the past year and a half.\u00a0 \u00a0The Hamas terrorist attack on October 7th<\/sup>\u00a0was outrageous and reprehensible.\u00a0\u00a0But the Israel attack on the citizens of Gaza, regardless of whether they were Hamas or not, was equally, and in some eyes, even more, reprehensible.\u00a0\u00a0It divided the Democratic Party, so much so that it may have cost America the Trump Presidency instead of Harris.\u00a0\u00a0<\/p>\n\n\n\n

But what\u2019s happening to Khalil is a \u201cProgressive\u201d nightmare.\u00a0\u00a0He did exactly what we thought was \u201cprotected\u201d by the First Amendment,\u00a0\u00a0that \u201c\u2026Americans can think and say our politics view, without ‘the government’ coming against us.\u201d\u00a0\u00a0 Now, by a twist of a phrase, an arbitrary correlation by the White House, a permanent resident of the United States, a young man with a child on the way, is likely to be thrown out of our Nation.\u00a0\u00a0What\u2019s next?<\/p>\n\n\n\n

Martin Niemoller, the German-Lutheran Pastor who stood against the Nazis, put it this way:<\/p>\n\n\n\n

First they came for the Communists, and I did not speak out<\/em>
Because I was not a Communist.
Then they came for the Socialists, and I did not speak out
Because I was not a Socialist.
Then they came for the trade unionists, and I did not speak out
Because I was not a trade unionist.
Then they came for the Jews, and I did not speak out
Because I was not a Jew.<\/em><\/p>\n\n\n\n

Then they came for me,<\/em>
And there was no one left to speak out for me<\/em>.<\/p>\n\n\n\n
