th<\/sup>\u00a0President of the United States.\u00a0\u00a0For both sides of the Great American Political Divide, the amount of \u201cExecutive\u201d activity has been\u2026dizzying, overwhelming, invigorating, terrifying, satisfying, and threatening.\u00a0\u00a0\u00a0The dust hasn\u2019t settled.\u00a0\u00a0But there does seems to be a slight delay in the juggernaut of executive action today.\u00a0\u00a0The White House has agreed to limit access to the Treasury Department\u2019s computerized spending programs.\u00a0 \u00a0The \u201cboys\u201d from DOGE, are now blocked from ravaging through that particular dataset.<\/p>\n\n\n\nIt’s a moment where we can step back to look at what the authority of the \u201cmost powerful office in the world\u201d really is. <\/p>\n\n\n\n
The Constitution of the United States carefully divided the powers of the Federal Government. \u00a0\u00a0Many remember their Eighth Grade American History class, where the three branches were outlined:\u00a0\u00a0legislative (Congress) wrote the laws; executive (President) enforced those laws, judicial (Federal Courts) interpreted both the laws and the Constitution itself.\u00a0\u00a0My eighth grade teacher extolled the brilliance of \u201cMadisonian Democracy\u201d, the intricate intertwining of \u201cchecks and balances\u201d.\u00a0\u00a0No one branch could act without cooperation of the other, at least in principal.\u00a0\u00a0And the Courts, thanks to John Marshall\u2019s early assertions, became the impartial arbiter of power.<\/p>\n\n\n\n
Mandate or Division<\/h3>\n\n\n\n
We are in a new era of American politics.\u00a0\u00a0 The people are divided, as Mr. Trump might say, \u201clike never before\u201d (well, there was that time around the Civil War).\u00a0\u00a0But, by incredibly slim margins, the Government itself is of one mind.\u00a0\u00a0Mr. Trump declares that his electoral comeback is an unfettered mandate for action, despite getting less than half of the Presidential votes.\u00a0\u00a0The House of Representatives are Republican by three seats (out of 433).\u00a0\u00a0The Senate is Republican by four seats (out of 100).\u00a0\u00a0And the newly partisan Supreme Court also now has \u201ca side\u201d, six aligned with the Republican agenda, and three aligned with the Democratic side.<\/p>\n\n\n\n
MAGA-Republican control of all three branches of Government has \u201cgreased the rails\u201d for Mr. Trump, and he knows it.\u00a0\u00a0 He has the \u201ccarrot\u201d; achieving the his MAGA goals.\u00a0\u00a0And he has the \u201cstick\u201d of his MAGA base, willing to throw aside any Republican who might stand up against the onslaught.\u00a0\u00a0Add to that, Trump also has the power; billions of dollars supplied by one of the richest men in the world, to back down any internal opposition.\u00a0\u00a0<\/p>\n\n\n\n
The stars are aligned to allow Trump to do almost anything.\u00a0 \u00a0What all of those Democrats warned about:\u00a0\u00a0the authoritarian streak in the Trump ideology and the clear desire for vengeance against his enemies; is now apparent.\u00a0\u00a0And the danger represented to world peace by a man who says; we\u2019ll just take over the Gaza Strip ourselves, along with Greenland, Canada and the Panama Canal, is obvious.<\/p>\n\n\n\n
Who Rules<\/h3>\n\n\n\n
So is Trump the nightmare Presidency, the end of the Republic, the beginning of a Fascist regime that everyone, from Joe Biden on down, warned about?\u00a0\u00a0 He might be.\u00a0\u00a0And if he is, it\u2019s because Congress and the Supreme Court determines not to defend their own Constitutional powers.<\/p>\n\n\n\n
If Congress \u201cmakes the laws\u201d, than a President cannot create a Department of the government without a \u201claw\u201d passed by Congress.\u00a0 \u00a0So what is DOGE, the \u201cDepartment of Government Efficiency\u201d.\u00a0\u00a0For sure, currently, it is NOT a Department of the US Government.\u00a0\u00a0I\u2019m not even sure it can operate as an \u201carm\u201d of the Office of Management and Budget.\u00a0\u00a0But the President, and his Henchman-in-Chief, Elon Musk, simply have asserted authority.\u00a0\u00a0And Congress is not standing against it (at least the majority of Congress, the Democratic minorities are screaming from the rooftops!).<\/p>\n\n\n\n
The Trump Administration issued hundreds of executive orders. \u00a0\u00a0Some of those are \u201cjust\u201d edicts:\u00a0\u00a0what the President would like to do, but doesn\u2019t have the authority to do so.\u00a0\u00a0Dissolving the Department of Education is one of those.\u00a0\u00a0Sure, that\u2019s been a Republican bug-a-boo for decades; but what Congress \u201cgiveth\u201d, only Congress can \u201ctaketh away\u201d.\u00a0\u00a0So Trump\u2019s order is nothing more than an announcement of his intent.\u00a0\u00a0It\u2019s Congress\u2019s intent that makes the difference.<\/p>\n\n\n\n
Another is the \u201cbirthright citizenship\u201d edict, changing American Constitutional law of almost a century and a half.\u00a0 \u00a0The President doesn\u2019t have the power to \u201cinterpret\u201d the Constitution, at least he didn\u2019t have it until now.\u00a0\u00a0By the current \u201crules\u201d, that\u2019s not his call.\u00a0\u00a0Will see what the Courts say to that.<\/p>\n\n\n\n
Immunity<\/h3>\n\n\n\n
By the way, there\u2019s a method to the madness of the flurry of paper orders coming from the White House.\u00a0\u00a0 The Supreme Court has charted a path.\u00a0\u00a0The President is \u201cimmune\u201d from criminal liability for anything within his \u201cofficial duties\u201d.\u00a0\u00a0So, whatever is on an \u201cexecutive order\u201d is official.\u00a0\u00a0You can hear the Trump lawyers brains clicking away \u2013 they\u2019ve got a prima-facie case of immunity should he (or they) are ever be held accountable, again.<\/p>\n\n\n\n
Can the Executive fire hundreds, maybe thousands of Federal employees?\u00a0\u00a0The answer to that is\u00a0\u00a0a no as well.\u00a0\u00a0 There are a series of laws, (passed by Congress), establishing a civil service outside of the political realm of White House control.\u00a0\u00a0Trump alone cannot violate civil service, even if he writes an order, or even if he devolves the authority to fire to a subordinate, like Elon Musk and the \u201cDOGE\u201d boys.\u00a0\u00a0And, by the way, they can\u2019t offer a retirement buyout unilaterally either:<\/p>\n\n\n\n
Federal employees beware.<\/p>\n\n\n\n
Tradition<\/h3>\n\n\n\n
There is an ultimate \u201cexception\u201d to all of this.\u00a0 \u00a0While Congress may decide not to defend their own powers, the \u201clast, best resort\u201d are the Federal Courts.\u00a0\u00a0And while there are plenty of Federal Judges at the District and Appellate levels who will rule against Trump\u2019s usurpations, when it finally reach the Supreme Court the outcome might not be so obvious.\u00a0\u00a0After all, six of the Justices granted Trump unprecedented immunity from prosecution.\u00a0\u00a0Who knows how far they might be willing to let him go with his \u201cexecutive actions\u201d.\u00a0<\/p>\n\n\n\n
First we depended on tradition, but this President didn\u2019t respect tradition.\u00a0 \u00a0Then we depended on \u201cnorms\u201d, but this one didn\u2019t care about rules.\u00a0\u00a0Then we depended on process, but Congress failed to check extreme Presidential actions.\u00a0\u00a0Finally we depended on \u201cthe people\u201d, but the people were \u201cfooled again\u201d.\u00a0\u00a0Can we depend on the Supreme Court to maintain Madisonian Democracy?<\/p>\n\n\n\n
And if the Court does restrain the President, can we expect Donald Trump to abide by their ruling?\u00a0 \u00a0Or will he echo his hero, Andrew Jackson.\u00a0\u00a0When Jackson determined, on his own, to move the Native American tribes across the Mississippi River and into Oklahoma, the Supreme Court said no.\u00a0\u00a0Jackson famously said:\u00a0\u00a0\u201cJohn Marshall made his decision, let him enforce it\u201d, and continued the \u201cIndian Removal\u201d, including the Trail of Tears.\u00a0\u00a0He ignored the Supreme Court.\u00a0\u00a0Nothing happened to Jackson.\u00a0\u00a0Would Trump be held accountable?<\/p>\n\n\n\n
