{"id":7079,"date":"2024-04-29T07:33:37","date_gmt":"2024-04-29T11:33:37","guid":{"rendered":"https:\/\/dahlman.online\/?p=7079"},"modified":"2024-04-29T07:33:37","modified_gmt":"2024-04-29T11:33:37","slug":"presidential-immunity","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2024\/04\/29\/presidential-immunity\/","title":{"rendered":"Presidential Immunity"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Fire Blanket<\/h3>\n\n\n\n<p class=\"\">It\u2019s a seductive argument, one that Dick Cheney and folks who grew watching the TV show \u201c24\u201d would understand.\u00a0\u00a0They argue that sometimes the President of the United States has to break the law in order to protect the Nation.\u00a0\u00a0Sometimes he has to do the \u201cdirty work\u201d, the nasty, wet work, that the general public doesn\u2019t need, or want, to know.\u00a0\u00a0At least, that\u2019s what they think.<\/p>\n\n\n\n<p class=\"\">I mentioned Dick Cheney, because those of us who are old enough remember the \u201cDarth Vader\u201d of the George W Bush administration.\u00a0After 9-11, it was Dick Cheney, at the \u201cundisclosed location\u201d, who orchestrated America\u2019s response.\u00a0\u00a0Sure, the President was out there speaking at the World Trade Center site;\u00a0<em>\u201c\u2026I can hear you!\u00a0\u00a0The rest of the world hears you, and the people who knocked these buildings down will hear all of us soon<\/em>\u201d.<\/p>\n\n\n\n<p class=\"\">But Cheney was preparing to get intelligence on those \u201cpeople\u201d, in any way he could.\u00a0\u00a0He made sure that a Justice Department lawyer, John Yoo (now a professor at Cal-Berkley Law School), authored a memo saying waterboarding, stress positions, enforced nudity, forced simulated sex positions, sleep deprivation, and auditory overload were all; \u201cnot torture\u201d.\u00a0\u00a0And then Cheney sent American forces out to find  who could identify the ones that \u201c\u2026knocked these buildings down\u201d. They were kidnapped, and sent to \u201cblack sites\u201d that were NOT on American soil so US Courts could not intervene.<\/p>\n\n\n\n<p class=\"\">Those folks were  &#8220;interrogated, not tortured\u201d, according to the \u201cmemo\u201d.&nbsp;&nbsp;And the information gained was generally \u201cnot valid\u201d.&nbsp;&nbsp;Senator John McCain, himself tortured and permanently disabled by the North Vietnamese said it best.&nbsp;&nbsp;There comes a point where you\u2019ll say anything to make it stop, true or not. Just give the torturers whatever they want to hear.<\/p>\n\n\n\n<p class=\"\">Why did Cheney get a Department of Justice, Office of Legal Counsel memo?\u00a0\u00a0Because he needed cover, a paper fire-blanket to wrap around himself.\u00a0\u00a0He knew:\u00a0\u00a0someday somebody would say the obvious, that\u00a0\u00a0\u201ctorture is wrong and that was torture\u201d.\u00a0\u00a0Cheney needed a get out of jail card, and John Yoo wrote it for him.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Criminal Liability<\/h3>\n\n\n\n<p class=\"\">And what\u2019s important about that now?&nbsp;&nbsp;Because if Dick Cheney thought the President of the United States (under whose authority he was acting) was immune from criminal prosecution, then he wouldn\u2019t have bothered with John Yoo\u2019s&nbsp;&nbsp;infamous work.<\/p>\n\n\n\n<p class=\"\">Richard Nixon wouldn\u2019t have taken a pardon from Gerald Ford after he resigned from office.&nbsp;&nbsp;Nor would Bill Clinton gotten a plea deal where he lost his law license for committing perjury under oath.&nbsp;&nbsp;&nbsp;The bottom line:&nbsp;&nbsp;every President since George Washington knew that if they broke the law, they could be held accountable.&nbsp;&nbsp;The Presidents knew they were safe from legal action while in office, barring impeachment and conviction.&nbsp;&nbsp;And they also knew that they weren\u2019t immune after they left office.<\/p>\n\n\n\n<p class=\"\">The Founding Fathers were surely spinning in their graves last week.&nbsp;&nbsp;The Supreme Court of the United States seemed to be seriously considering whether a President has immunity from criminal prosecution, not just in office, but for life.&nbsp;&nbsp;That is perilously close to creating a \u201csovereign king\u201d, the one thing all of the Founding Fathers pledged \u201c\u2026their lives, their fortunes and their sacred honor\u201d to end.&nbsp;&nbsp;When lawyers for the ex-President made the argument that George Washington would agree with them, historians were aghast.&nbsp;&nbsp;We all know better, as does every school-kid in America.&nbsp;&nbsp;And so do those lawyers, and the nine solemn judges on the bench.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Russian Roulette<\/h3>\n\n\n\n<p class=\"\">Former Attorney General Bill Barr summed up the view for a few of those Justices last week.&nbsp;&nbsp;Barr sees Trump as a dangerous individual, a \u201cRussian Roulette\u201d choice as President.&nbsp;&nbsp;But he sees the \u201cProgressive Agenda\u201d of the Biden Administration as so dangerous, an \u201cexistential threat\u201d; that he is willing to \u201cspin the barrel\u201d and pull the trigger on a second Trump Presidency.<\/p>\n\n\n\n<p class=\"\">I suspect Justices Thomas, Alito, Gorsuch and perhaps Barrett all feel that same way.&nbsp;&nbsp;They certainly seem willing to distort American legal history, and create a new \u201cimmunity\u201d out of whole cloth to wrap around Donald Trump.&nbsp;&nbsp;And that immunity is absolutely \u201cgas on a fire\u201d when it comes to the ex-President.<\/p>\n\n\n\n<p class=\"\">By any measure, the previous Trump candidacy and Presidency was characterized by the destruction of \u201cnorms\u201d.\u00a0Norms are the unwritten rules that controlled American government, from Senate approval of executive department leaders (Trump filled many offices with temporary leaders) to taking moral stands in American crises (\u201cgood people on both sides\u201d), to the peaceful transition of power from one President to another.\u00a0\u00a0We know all about that one. Trump broke ignored the norms.<\/p>\n\n\n\n<p class=\"\">And several members of the Supreme Court seem to be seriously considering whether to remove not a norm, but an actual disincentive to breaking laws:\u00a0\u00a0legal, criminal responsibility.\u00a0\u00a0One of the Justices mentioned the now infamous \u201cSeal Team Six\u201d scenario, that came up in the Appellate Court argument.\u00a0\u00a0\u201cWhat if the President ordered Seal Team Six to assassinate his political opponent. Would he have immunity from the criminal liability then?\u201d\u00a0\u00a0The\u00a0\u00a0Trump\u00a0\u00a0response in the DC Circuit was: only if he was impeached and convicted first.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Command Responsibility<\/h3>\n\n\n\n<p class=\"\">But Justice Alito blew through that scenario.&nbsp;&nbsp;He simply said that Seal Team Six was bound by the Uniform Code of Military Justice, and so wouldn\u2019t obey an \u201cillegal order\u201d, even from the President.&nbsp;&nbsp;But what if they did obey a Presidential command?&nbsp;&nbsp;Well, they would be criminally liable.&nbsp;&nbsp;So the executors would be liable, but the actual commander would not be?<\/p>\n\n\n\n<p class=\"\">Every Four Star General and Admiral knows they are responsible for their actions.&nbsp;&nbsp;Every Department Secretary is as well.&nbsp;&nbsp;So why would the President, the most powerful \u201cman in the world\u201d, not be held to the same standard as their subordinates?&nbsp;&nbsp;The short answer is:&nbsp;&nbsp;for 235 years, up until today, they have been.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"\">Hebert Hoover sent the US military to clear the \u201cBonus Army\u201dfrom the National Mall  in 1932.&nbsp;&nbsp;Franklin Roosevelt interned American citizens of Japanese descent.&nbsp;&nbsp;Truman used the atomic bomb.&nbsp;&nbsp;Lyndon Johnson lied about Vietnam, and Richard Nixon covered up a felony break-in.&nbsp;&nbsp;Bill Clinton made a deal, and George W Bush kidnapped foreign citizens, transported them to foreign bases, and had them tortured.&nbsp;&nbsp;Barack Obama had an American citizen killed by drone strike, and sent Seal Team Six to kill Bin Laden. &nbsp;<\/p>\n\n\n\n<p class=\"\">All of them, faced the possibility of criminal action.&nbsp;&nbsp;And all of them, right or wrong, did what they thought was best in their crisis.&nbsp;&nbsp;So who can\u2019t handle it?&nbsp;&nbsp;Who needs a Supreme Court designated \u201cget out of jail\u201d card?&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"\">Of  course; it\u2019s the Ex-President and current candidate, Donald Trump.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fire Blanket It\u2019s a seductive argument, one that Dick Cheney and folks who grew watching the TV show \u201c24\u201d would understand.\u00a0\u00a0They argue that sometimes the President of the United States has to break the law in order to protect the Nation.\u00a0\u00a0Sometimes he has to do the \u201cdirty work\u201d, the nasty, wet work, that the general &hellip; <a href=\"https:\/\/dahlman.online\/index.php\/2024\/04\/29\/presidential-immunity\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Presidential Immunity&#8221;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","om_disable_all_campaigns":false,"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[1],"tags":[],"class_list":["post-7079","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
