{"id":6827,"date":"2023-12-05T10:44:19","date_gmt":"2023-12-05T15:44:19","guid":{"rendered":"https:\/\/dahlman.online\/?p=6827"},"modified":"2023-12-05T10:44:23","modified_gmt":"2023-12-05T15:44:23","slug":"power-to-the-people","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2023\/12\/05\/power-to-the-people\/","title":{"rendered":"Power to the People"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Progressivism<\/h3>\n\n\n\n<p>I stepped back into a US History classroom last week. After a career in History classes, it was refreshing to be in a room where I had some expertise.\u00a0\u00a0While I enjoy substitute teaching, even in Pre-Calculus and Physics; it\u2019s not like I can help the students out much in those classes.\u00a0\u00a0Google Classroom is really \u201cin charge\u201d.\u00a0\u00a0But US History:  yes, I still know \u201cmy stuff\u201d.\u00a0\u00a0<\/p>\n\n\n\n<p>The topic of the day was the \u201cProgressive Movement\u201d,\u00a0\u00a0the era of the late 1890\u2019s into the early 20<sup>th<\/sup>\u00a0Century.\u00a0\u00a0For those who might be a little rusty, Progressives were able to pass four US Constitutional Amendments:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The graduated income tax (16), <\/li>\n\n\n\n<li>Direct election of US Senators (17), <\/li>\n\n\n\n<li>Ban the sale of alcohol in the US (18), and<\/li>\n\n\n\n<li>Grant women the right to vote (19).\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p>If that doesn\u2019t jog your memory, perhaps you remember President Teddy Roosevelt (and even more, Ohio\u2019s own Williams Howard Taft) \u201cbusting\u201d the trusts, the massive business monopolies that controlled American commerce.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The People<\/h3>\n\n\n\n<p>The Progressives also made same serious changes at the state level.\u00a0 The state legislatures were dominated by corporate interests. (Think $60 million and the First Energy Corporation\u2026oh wait, that was a couple of years ago). Progressives developed a \u201cbypass\u201d plan.\u00a0\u00a0Initiative and Referendum allowed the people of a state to directly vote on State Constitutional amendments or laws. (Initiative is when the people initiate the vote, referendum is when the people either ratify or reject a proposal of the state legislature).\u00a0\u00a0\u00a0Politically, \u201cthe people\u2019s vote\u201d gave politicians \u201ccover\u201d from their financial backers \u2013 \u201cI didn\u2019t vote for it, but the people did!!\u201d<\/p>\n\n\n\n<p>And the perfect example of initiative is the people passing a law that the state legislature refused to touch.&nbsp;&nbsp;It\u2019s the marijuana initiative passed in Ohio last month.<\/p>\n\n\n\n<p>The marijuana initiative passed with 57% of the popular vote.\u00a0\u00a0And though it was on the ballot in November of 2023, there was a huge turnout.   48% of registered voters, voted, just slightly less than a normal \u201coff-even-year\u201d election of around 50%. (Presidential election years run around 70% turnout).\u00a0\u00a0So there was a serious margin of victory, and a serious number of votes.\u00a0\u00a0To put it simply, over 2 million Ohioans wanted the initiative to pass.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Initiative<\/h3>\n\n\n\n<p>And what did the initiative say?&nbsp;<\/p>\n\n\n\n<p><em>Issue 2 legalized and provided for the regulation of recreational marijuana for adults aged 21 and above, including cultivation, processing, sale, purchase, possession, and home growth. Under the initiative, adults are allowed to possess up to 2.5 ounces of marijuana and up to 15 grams of marijuana concentrates. Additionally, individuals are allowed to cultivate up to six marijuana plants at home, while households can cultivate up to 12 plants collectively.&nbsp;<\/em><\/p>\n\n\n\n<p><em>The Division of Cannabis Control, created under the initiative, is responsible for regulating and licensing marijuana operators and facilities and is responsible for overseeing the compliance and standardization of marijuana businesses and production in Ohio. Licensing for distributing facilities was expected to be complete around Fall 2024.&nbsp;<\/em><\/p>\n\n\n\n<p><em>Under Issue 2, marijuana sales were set to be taxed at 10%. The revenue generated from this tax was set to be directed toward establishing a&nbsp;cannabis social equity and jobs program,&nbsp;designed to provide financial support and assistance for license applications to individuals who have been disproportionately affected by past marijuana-related law enforcement (<a href=\"https:\/\/ballotpedia.org\/Ohio_Issue_2,_Marijuana_Legalization_Initiative_(2023)\">Ballotpedia<\/a>).<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Like It or Not<\/h3>\n\n\n\n<p>Look, you can like the new marijuana law, or not.&nbsp;&nbsp;You can think that marijuana is already endemic in our society, and might as well be legal, or you can think it\u2019s just another \u201cevil\u201d to add to alcohol \u2013 a bad idea.&nbsp;&nbsp;But the people of the State of Ohio have spoken \u2013 in large numbers.&nbsp;&nbsp;No one \u201csnuck\u201d marijuana legalization under the table.&nbsp;&nbsp;The new \u201claw\u201d is scheduled to go into effect on December 7<sup>th<\/sup>, (that\u2019s the day after tomorrow).&nbsp;&nbsp;&nbsp;And, as we live in a democracy, where we respect the \u201cvoice of the people\u201d, it\u2019s a \u201cdone deal\u201d; right?<\/p>\n\n\n\n<p>The words \u201crespect\u201d and \u201cvoice of the people\u201d don\u2019t resonate with the Legislature of the State of Ohio.&nbsp;&nbsp;&nbsp;Here\u2019s the \u201cmodifications\u201d the Republicans in the State Senate are proposing.<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ul class=\"wp-block-list\">\n<li><em>eliminate the opportunity for adults to legally home cultivate marijuana<\/em><\/li>\n\n\n\n<li><em>significantly increase cannabis-related taxes on the sale and manufacture of retail products (<\/em>from 10% to 15%)<em><\/em><\/li>\n\n\n\n<li><em>severely decrease how much cannabis adults may legally possess at any one time; eliminate social equity support for marijuana-related businesses (<\/em>tax revenues would instead go to the state \u2018general fund\u2019<em>)<\/em><\/li>\n\n\n\n<li><em>impose arbitrarily low THC potency limits on cannabis flower and other products;<\/em><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>decrease the number of licensed retailers<\/em><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>keep marijuana possession criminalized until adult use dispensaries are operational, likely at least 12 months from now (<a href=\"https:\/\/norml.org\/blog\/2023\/12\/04\/ohio-legislature-attempting-to-gut-legalization-initiative-days-before-implementation-of-key-provisions\/\">NORML<\/a>\u00a0\u2013\u00a0<\/em>items in parentheses from local news).<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<p>Full disclosure:\u00a0\u00a0while the Senate wants to make these changes to \u201cthe will of the people\u201d, the State House isn\u2019t so gung-ho about it.\u00a0\u00a0And while the Governor is clearly on the side of \u201cmodifying\u201d the initiative as passed, he isn\u2019t willing to go so far either.\u00a0\u00a0But the Senate proposal begs the question:\u00a0\u00a0what\u2019s the political upside of going in the face of more than 2 million Ohioans?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In Their Face<\/h3>\n\n\n\n<p>What are the \u201cpowers that be\u201d in the State of Ohio, that seem to be even more powerful than 2 million voters making their will clear?&nbsp;&nbsp;&nbsp;First, it\u2019s the right-wing, and often Christian fundamentalists of the state.&nbsp;&nbsp;While they don\u2019t hold a majority, they do represent the vast majority of the Republican voter base, the voters in the political primaries.&nbsp;&nbsp;And this same legislature has gerrymandered the state to the extent that a state that voted less than 55% Republican in 2020 has a legislature that\u2019s more than 66% Republican.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In short, Republicans are more worried about winning their primary, than the general election that follows it.&nbsp;&nbsp;And primary elections are won in the base.&nbsp;&nbsp;Those legislators aren\u2019t worried about what the state \u201cthinks\u201d, but they are worried about getting \u201cprimaried to the right\u201d.&nbsp;&nbsp;So they are perfectly willing to \u201cbuck\u201d a statewide decision; their carefully curated districts don\u2019t include many of \u201cthose\u201d folks.<\/p>\n\n\n\n<p>Second, there\u2019s a powerful beer, wine, and liquor lobby,&nbsp;&nbsp;donating millions of dollars to Ohio legislators.&nbsp;&nbsp;They\u2019re worried about the impact of legalized marijuana on their own product sales, though, limited studies show it\u2019s actually a reverse effect.&nbsp;&nbsp;Legalization seems to increase local alcohol sales (<a href=\"https:\/\/medicalxpress.com\/news\/2022-11-legalizing-marijuana-states-alcohol-consumption.html#:~:text=The%20researchers%20note%20that%20their,states%20after%20legalization%20of%20marijuana.\">Medical Express<\/a>). (<em>And probably the sale of brownies and potato chips as well).<\/em><\/p>\n\n\n\n<p>These Senators agree with former Senator and Presidential candidate Republican Rick Santorum. He said:\u00a0\u00a0<\/p>\n\n\n\n<p><em>\u201cThank goodness that most of the states in this country don\u2019t allow you to put everything on the ballot, because pure democracies are not the way to run a country,\u201d Santorum said Tuesday night on Newsmax (<a href=\"https:\/\/thehill.com\/homenews\/campaign\/4299354-santorum-ohio-results-pure-democracies\/#:~:text=Ohio%20voters%20overwhelmingly%20approved%20separate,and%20vote%2C%E2%80%9D%20Santorum%20said.\">The Hill<\/a>).<\/em><em><\/em><\/p>\n\n\n\n<p>Pure Democracy \u2013 well certainly the Ohio Senate is making their feelings clear about that.&nbsp;&nbsp;Democracy must be the enemy of \u2013 what &#8211; partisan political power?<\/p>\n\n\n\n<p>That\u2019s certainly what the Progressives thought, more than a century ago.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Progressivism I stepped back into a US History classroom last week.
