{"id":6573,"date":"2023-08-02T08:49:31","date_gmt":"2023-08-02T12:49:31","guid":{"rendered":"https:\/\/dahlman.online\/?p=6573"},"modified":"2023-08-02T08:49:35","modified_gmt":"2023-08-02T12:49:35","slug":"indicted-co-conspirator","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2023\/08\/02\/indicted-co-conspirator\/","title":{"rendered":"Indicted Co-Conspirator"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li><em>So I worked all yesterday on an essay entitled \u201cHanging Fire\u201d.\u00a0\u00a0It was about the media vacuum created while waiting for Jack Smith to indict Donald Trump, and what filled it.\u00a0\u00a0Maybe I can use it somewhere else.\u00a0\u00a0At 5 pm on August 1, 2023; the Federal Grand Jury in Washington, DC,\u00a0\u00a0indicted the former President of the United States for attempting to overturn the Presidential election of 2020.<\/em><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Peaceful Transition<\/h3>\n\n\n\n<p>August 1, 2023: Donald J Trump, the 45<sup>th<\/sup>\u00a0President of the United States, indicted by a Federal Grand Jury for attempting to disrupt the peaceful transition of power from one President to the next.\u00a0\u00a0It is a bookmark in American History, beside August 8, 1974 (Nixon\u2019s resignation) and November 22, 1963 (Kennedy\u2019s Assassination).\u00a0\u00a0<\/p>\n\n\n\n<p>In American History  this \u201cfoundation\u201d of democracy was established in 1801.\u00a0\u00a0President John Adams, a Federalist; peacefully turned over the Presidency to his arch-rival, Democratic-Republican Thomas Jefferson.\u00a0\u00a0There were no riots, no troops in the streets.\u00a0\u00a0Adams simply got in his carriage and headed back to his home in Braintree, Massachusetts. Jefferson took the oath of office and moved into the new White House.<\/p>\n\n\n\n<p>The precedent continued For the next two-hundred and sixteen years.\u00a0\u00a0Buchanan left a looming Civil War to Lincoln.\u00a0\u00a0Democrat Cleveland left the White House to Republican Harrison, to win it back four years later.\u00a0\u00a0The unelected President, Gerald Ford, greeted Jimmy Carter on the White House steps. The elder Bush left a sweet note in the Resolute Desk to Clinton, and\u00a0\u00a0proud Obama did all he could to assist Trump.\u00a0\u00a0But in 2020,  that precedent was broken.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">USC 18 \u00a7 238<\/h3>\n\n\n\n<p>Some of us wanted the former President held to the highest standard.&nbsp;&nbsp;We believe that Trump committed Insurrection and Sedition, leading the Nation to the crisis that still threaten our founding principles.&nbsp;&nbsp;But Special Prosecutor Jack Smith and the Grand Jury did not charge him with that, outlined in&nbsp;USC 18&nbsp;\u00a7 2383. It states:&nbsp;<\/p>\n\n\n\n<p><em>\u201cWhoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto,<\/em><em>&nbsp;<\/em><em>shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.\u201d&nbsp;<\/em><\/p>\n\n\n\n<p>Prosecutor Smith must not believe he has the ironclad evidence to prove rebellion and insurrection.&nbsp;&nbsp;So he proffered four \u201clesser\u201d charges, all still with large punishments.&nbsp;&nbsp;But those charges do not include the final phrase: \u201c\u2026<em>and shall be incapable of holding any office under the United States\u201d.&nbsp;&nbsp;<\/em>Even if convicted of the four charges Smith laid out yesterday, Trump could still be elected President.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Process<\/h3>\n\n\n\n<p>Jack Smith did not focus on the Insurrection itself, the storming of the Capitol that most watched in horror, and some in MAGA-inspired glee.&nbsp;&nbsp;Instead, he focused on the process of Trump\u2019s attempts to disrupt the count of popular votes for President, and alter the selection of electors in the arcane Constitutional process called the \u201cElectoral College\u201d.&nbsp;&nbsp;There are four counts in this indictment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Conspiracy to defraud the United States<\/strong> (by knowingly lying about the results of the 2020 Presidential election)<\/li>\n\n\n\n<li><strong>Conspiracy to Obstruct an Official Proceeding<\/strong> (by creating \u201cfake\u201d electors and attempting to have them counted)<\/li>\n\n\n\n<li><strong>Obstruction of and Attempt to Obstruct an Official Proceeding<\/strong> (the direct disruption of the Congressional counting of electoral votes on January 6<sup>th<\/sup>, including encouraging the rioters and pressuring Vice President Pence)<\/li>\n\n\n\n<li><strong>Conspiracy Against Rights<\/strong> (attempting to take away the legal votes of citizens in violation of their Constitutional right to vote).<\/li>\n<\/ul>\n\n\n\n<p>The sum possible penalty for conviction of all four offenses is a maximum of sixty-five years in prison.&nbsp;&nbsp;While the Federal Courts never give that kind of maximum, certainly a ten or more year sentence could be levied.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Indictment<\/h3>\n\n\n\n<p>The forty-five page indictment is written in clear language (not \u201clegalese\u201d).&nbsp;&nbsp;It outlines all of the demonstrable facts that Smith will bring to court to prove each count of the indictment.&nbsp;&nbsp;&nbsp;Read it with the knowledge that each \u201cfact\u201d is supported by evidence.&nbsp;&nbsp;There no longer is supposition, \u201c\u2026well Trump must have known\u201d.&nbsp;&nbsp;Instead, there is direct evidence that in fact Trump did know; he knew that he lost the 2020 election, he knew that Biden was the next President, but continued to lie about it.&nbsp;&nbsp;Beyond that lie, he led and directly participated in a conspiracy to overthrow the vote of the people, and have himself falsely installed as the next President of the United States.&nbsp;&nbsp;<\/p>\n\n\n\n<p>That conspiracy was based on obscure and outlandish interpretations of the law. Even those who created them knew they were wrong (Eastman stated that the Supreme Court would rule against him unanimously).\u00a0\u00a0But the President and his co-conspirators proceeded ahead anyway.\u00a0\u00a0Power was more important than the Constitution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conspiracy<\/h3>\n\n\n\n<p>The indictment does not name the co-conspirators.\u00a0\u00a0Some of them are obvious:\u00a0\u00a0Co-Conspirator 1 is lawyer Rudy Giuliani who led the effort to alter the vote count. Number 2 is John Eastman who developed the \u201cConstitutional theory\u201d to overturn the Electoral vote. Co-Conspirator 3\u00a0\u00a0is Sidney Powell.  She joined Giuliani trying to convince America that the election was corrupted.\u00a0<\/p>\n\n\n\n<p>Co-Conspirator 4 is Assistant Attorney General Jeff Clark, who attempted to use the Justice Department to sow doubt in the election results.\u00a0 5 is Kevin Chesbro, a lawyer in Wisconsin who developed a \u201clegal basis\u201d to throw out legally chosen electors and replace them with Trump electors.<\/p>\n\n\n\n<p>Co-Conspirator 6 is still less certain, though it may well be past and current Trump advisor Jason Miller, who helped implement the \u201cfake electors\u201d strategy to overturn the January 6<sup>th<\/sup>&nbsp;Congressional certification process.<\/p>\n\n\n\n<p>But  these six were not charged.\u00a0\u00a0Donald Trump is the lone person indicted.<\/p>\n\n\n\n<p>(<em>Oddly missing as a co-conspirator to Trump\u2019s Chief of Staff Mark Meadows, at the center of almost all of these actions.&nbsp;&nbsp;Speculation \u2013 has Meadows turned \u201cstate\u2019s evidence\u201d?)<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Time<\/h3>\n\n\n\n<p>Time is of the essence.&nbsp;&nbsp;While we are farther from the 2024 election that it \u201cfeels\u201d, it seems crucial that the trial result of Donald Trump should be available for the American voters when they walk into the ballot booth in November of 2024.&nbsp;&nbsp;Smith didn\u2019t want the complexity of a seven person trial; seven different defense attorneys, seven different culpabilities to prove.&nbsp;&nbsp;Instead, he is laser focused on the center of the conspiracy:&nbsp;&nbsp;Donald Trump.&nbsp;&nbsp;That doesn\u2019t mean that the other six, and others not indicted, won\u2019t face justice.&nbsp;<\/p>\n\n\n\n<p>It\u2019s just that justice for Trump cannot be delayed.&nbsp;<\/p>\n\n\n\n<p><em><a href=\"https:\/\/apnews.com\/trump-election-2020-indictment\">The Indictment<\/a><\/em><\/p>\n\n\n\n<h1 class=\"wp-block-heading\">&nbsp;<\/h1>\n\n\n\n<h1 class=\"wp-block-heading\">&nbsp;<\/h1>\n\n\n\n<h1 class=\"wp-block-heading\">&nbsp;<\/h1>\n\n\n\n<h1 class=\"wp-block-heading\">&nbsp;<\/h1>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Peaceful Transition August 1, 2023: Donald J Trump, the 45th\u00a0President of the United States, indicted by a Federal Grand Jury for attempting to disrupt the peaceful transition of power from one President to the next.\u00a0\u00a0It is a bookmark in American History, beside August 8, 1974 (Nixon\u2019s resignation) and November 22, 1963 (Kennedy\u2019s Assassination).\u00a0\u00a0 In American &hellip; <a href=\"https:\/\/dahlman.online\/index.php\/2023\/08\/02\/indicted-co-conspirator\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Indicted Co-Conspirator&#8221;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","om_disable_all_campaigns":false,"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[1],"tags":[],"class_list":["post-6573","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
