{"id":6511,"date":"2023-07-06T09:01:50","date_gmt":"2023-07-06T13:01:50","guid":{"rendered":"https:\/\/dahlman.online\/?p=6511"},"modified":"2023-07-06T09:51:27","modified_gmt":"2023-07-06T13:51:27","slug":"small-world-politics","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2023\/07\/06\/small-world-politics\/","title":{"rendered":"Small World Politics"},"content":{"rendered":"\n<p><em>Note:  this essay was edited to correct that the marijuana initiative is a &#8220;statute&#8221; initiative rather than a Constitutional Amendment.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">New Game<\/h3>\n\n\n\n<p>I have a new game.&nbsp;&nbsp;I watch the political cable channels, and I do a countdown.&nbsp;&nbsp;When I flip on&nbsp;<em>MSNBC<\/em>, how long does it take until they are talking about Donald Trump?&nbsp;&nbsp;Then, very (very)  briefly, I switch over to&nbsp;<em>Fox News<\/em>.&nbsp;&nbsp;How long does it take them to mention Hunter Biden?&nbsp;&nbsp;It\u2019s kind of fun.&nbsp;&nbsp;That\u2019s \u201clarge world\u201d politics today, balancing the Left\u2019s fear of Trump against the Right\u2019s attack on Biden\u2019s son and perceived weakness. (And what about finding cocaine in the West Wing:  two plus two must equal\u2026Hunter!!!).&nbsp;<\/p>\n\n\n\n<p>But here in Ohio we have a \u201csmall world\u201d.&nbsp;&nbsp;What should be national scandals are just \u201cthe way it is\u201d.&nbsp;&nbsp;The former Speaker of the Ohio House of Representatives, Larry Householder, was just sentenced to twenty years in Federal prison.&nbsp;&nbsp;He \u201conly\u201d took a $60 million bribe, one that the First Energy Corporation admitted to giving him (they paid a $230 million fine).&nbsp;&nbsp;Householder took the bribe and got the State Legislature to bail out First Energy, saddling Ohio citizens with the cost of two aging nuclear plants. He even fended off a State Constitutional initiative to reverse the Legislature\u2019s plan. (<em>Ohioans might remember the commercial, \u201cChinese Communists are knocking on your door to take over your energy\u201d<\/em>).&nbsp;&nbsp;&nbsp;And he did some personal home improvements as well (worth hundreds of thousands of dollars).&nbsp;<\/p>\n\n\n\n<p>The former Chairman of the Ohio Republican Party was also found guilty in the case, getting five years. But while it was a \u201cFederal Case\u201d, here in Ohio there was limited publicity.&nbsp;&nbsp;And nationwide, it got a quick whitewash in the news (<a href=\"https:\/\/www.cnn.com\/2023\/06\/29\/politics\/larry-householder-ohio-speaker-sentenced-bribery-scheme\/index.html\">Left<\/a>&nbsp;or<a href=\"https:\/\/www.foxnews.com\/politics\/former-gop-ohio-house-speaker-larry-householder-sentenced-20-years-role-corruption-scandal\">&nbsp;Right<\/a>).&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Last Recourse<\/h3>\n\n\n\n<p>Householder\u2019s crimes were done in plain view of the Ohio voters.&nbsp;&nbsp;Opponents of \u201cbailing out\u201d First Energy even turned to a statewide \u201cinitiative\u201d to try to stop the now-criminal acts.&nbsp;&nbsp;It was the only choice left;  use a process written into the State Constitution in 1912 to counter the overwhelming influence of corporate money in the legislative process (Republican or Democratic, it really didn\u2019t matter).&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cInitiative and Referendum\u201d is relatively simple.\u00a0\u00a0By getting signatures statewide, \u201cregular\u201d citizens take the \u201cinitiative\u201d and put a proposal up for a vote of the entire state.\u00a0\u00a0What could have been a \u201cregular\u201d law  (statute) or Constitutional amendment proposed in the State Legislature, instead is put up for a vote of the citizens.  (The Legislature can also \u201crefer\u201d a proposal, a referendum.  More about that later).<\/p>\n\n\n\n<p>It&#8217;s a final \u201ccheck and balance\u201d, the last \u201crecourse\u201d for voters over the whole state legislative process.&nbsp;&nbsp;It\u2019s also a way for the Legislature to deal with difficult issues and \u201cpass the buck\u201d to the state\u2019s voters.&nbsp;&nbsp;It\u2019s not a sure thing.&nbsp;&nbsp;Over more than a century, Ohioans \u201cinitiated\u201d or the State Legislature \u201creferred\u201d 227 Constitutional Amendments or laws.&nbsp;&nbsp;126 passed, 101 were rejected (<a href=\"https:\/\/ballotpedia.org\/History_of_Initiative_%26_Referendum_in_Ohio\">Ballotpedia<\/a>).&nbsp;&nbsp;But the initiative to stop the First Energy bailout never made it on the ballot.&nbsp;&nbsp;The proponents couldn\u2019t get enough signatures:&nbsp;&nbsp;those \u201cChinese Communists weren\u2019t getting our energy, darn-it and tar-nation\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Magic Number!!!<\/h3>\n\n\n\n<p>Recently, the Ohio state legislators saw the results of women\u2019s health referendums in Kansas and Michigan.&nbsp;&nbsp;In both those states, around 58% of the voters agreed that women should have the right to control their own health care, including whether to have abortions or not.&nbsp;&nbsp;The Ohio Legislature was faced with the prospect of a similar initiative here. They risked losing control of the abortion issue.<\/p>\n\n\n\n<p>The State House is against abortion rights, and I\u2019m sure there are some legislators with close-held believes about abortion.&nbsp;&nbsp;But for many others, it\u2019s about re-election.&nbsp;&nbsp;Gerrymandering has made Ohio an extremely right-leaning legislature.&nbsp;&nbsp;Legislators worry not so much about the general elections, but the primaries, where they might be out-flanked to the right, out \u201cpro-life\u2019d\u201d by some opponent.&nbsp;&nbsp;<\/p>\n\n\n\n<p>But it\u2019s not just abortion.\u00a0\u00a0There is a second ballot initiative circulating, creating a law (not an Amendment) that would make recreational marijuana legal, joining twenty-three other states.\u00a0\u00a0Polling shows that close to 60% (there\u2019s that \u201cmagic\u201d number again) of Ohio voters are in favor of it.\u00a0\u00a0But for the legislature, recreational marijuana use is an issue fraught with difficulties.\u00a0\u00a0It\u2019s not about the pot:\u00a0\u00a0it\u2019s about the money, lots of money; billions of dollars in taxes and fees money.\u00a0\u00a0The legislature is afraid of losing control of that as well.<\/p>\n\n\n\n<p>It&#8217;s about money, it\u2019s about politics, it\u2019s about beliefs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Raise the Bar<\/h3>\n\n\n\n<p>So the State Legislature looked for a way to keep control of both abortion and dope.\u00a0\u00a0One idea was to \u201craise the bar\u201d on amendment initiatives.\u00a0\u00a0Instead of majority rule, 50% plus one, they want to raise the \u201cpass\u201d level to 60% (hey, that\u2019s the \u201cmagic number\u201d of support for both abortion rights and recreational marijuana).\u00a0\u00a0It would require a super-majority of the voters to pass any Constitutional initiative or referendum.\u00a0\u00a0Or, to put it another way, a minority of Ohioans, 40%, would control what the state does.<\/p>\n\n\n\n<p>Since changing the Ohio Constitution requires a Constitutional Amendment, the legislature \u201creferred\u201d the issue to a statewide vote, which now only needs to pass by 50<em>%.\u00a0\u00a0<\/em>And they decided to do it in a rare (and recently banned) August statewide vote.\u00a0\u00a0Why vote in August?\u00a0\u00a0Turnout in August elections are always extremely low (why they were banned).\u00a0\u00a0The Legislature hopes they can control who votes so their referendum wins.\u00a0\u00a0But second, and more important, if they can pass the Amendment in August, it then controls the Women\u2019s Rights Amendment scheduled to be on the November ballot.\u00a0\u00a0Passage of Issue One by 50%, would require 60% voting for that amendment to pass.  And while Marijuana is a statute initiative (not a Constitutional Amendment), the legislature vows to decimate it in the January session.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Absolute Power<\/h3>\n\n\n\n<p>Governor DeWine, Lieutenant Governor Husted, Secretary of State LaRose, the Republican state legislators, the Chamber of Commerce, all support raising the bar.\u00a0\u00a0Former Governors Kasich and Taft (both Republican), Democrats in the state legislators (the few, the proud), and all the expected interest groups are against it.\u00a0\u00a0But Ohio\u2019s August Issue One, the \u201craising the bar\u201d Amendment, isn\u2019t just about abortions.\u00a0\u00a0<\/p>\n\n\n\n<p>It&#8217;s about power, the power of the state legislature.&nbsp;&nbsp;And it\u2019s about the American concept of checks and balances.&nbsp;&nbsp;The current Ohio legislature doesn\u2019t want to be checked by anyone.&nbsp;&nbsp;They already have the votes to overrule the Governor\u2019s veto, and they have literally ignored past orders of the Ohio State Supreme Court.&nbsp;&nbsp;The only \u201ccheck\u201d left is this process of initiative.&nbsp;&nbsp;<\/p>\n\n\n\n<p>There\u2019s an old saying:&nbsp;&nbsp;\u201cPower corrupts, and absolute power corrupts absolutely\u201d.&nbsp;&nbsp;The Ohio legislature is already down the &#8220;corruption road&#8221; \u2013 ask Federal Prisoner Larry Householder.&nbsp;&nbsp;Ohioans need to keep their check to balance the state legislative power.&nbsp;&nbsp;They need to break the \u201cnorm\u201d and show up on August 8<sup>th<\/sup>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>They need to defeat Issue One.&nbsp;&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Note: this essay was edited to correct that the marijuana initiative is a &#8220;statute&#8221; initiative rather than a Constitutional Amendment.
