The Old Amish drive buggy\u2019s and wagons using reins and a short handle with a length of leather attached at the end. What starts as a \u201cbranch\u201d ends as a whip to \u201cencourage\u201d the horse to greater speed or strength.\u00a0\u00a0Farm animals aren\u2019t \u201cpets\u201d to the Amish – they are all business.\u00a0<\/em><\/p>\n\n\n\n

Dodds<\/h3>\n\n\n\n

On June 24th, 2022, more than half of the nation\u2019s citizens lost a right to control their own bodies. Mitch McConnell, Donald Trump and the Federalist Society got their \u201cfever dream\u201d wish when the US Supreme Court overruled\u00a0Roe v Wade<\/em>.\u00a0\u00a0In\u00a0Dodds v<\/em>\u00a0Jackson Women\u2019s Health<\/em>, they returned the determination of women\u2019s right to access abortion to state legislatures. The \u201cblack letter law\u201d of the United States for forty-nine years – that women have the right to choose abortion up through the fourth month of pregnancy – was abruptly ended.\u00a0<\/p>\n\n\n\n

The Court stood behind a veneer of returning power to the states.  But the six majority justices were well aware that over half of those states would immediately move to ban abortion.   Five of the six were completely comfortable with the idea.  Chief Justice Roberts looked for some compromise that would continue Court supervision of that \u201cright\u201d, but failed to win any takers from either side.  <\/p>\n\n\n\n

No Right to Privacy<\/h3>\n\n\n\n

The Majority attacked the \u201cright to privacy\u201d in the Constitution.\u00a0\u00a0They applied their \u201cOriginal Intent\u201d argument. Much like the Old Amish, they argue that if the founding fathers didn\u2019t specifically say so, then there is no \u201cextrapolation\u201d allowed to add Constitutionally protected rights.\u00a0\u00a0The obvious hypocrisy of the original authors, who saw making enslaved people three-fifths of a person for the purpose of taxation and representation but failed to grant them three-fifths of a vote, didn\u2019t seem to be a problem, for the founders, or the current Court Justices.<\/p>\n\n\n\n

So, while the Old Amish stretched their religious beliefs to use steel or rubber tires on their buggies, the idea that women would have right to their own bodies doesn\u2019t pass \u201cConstitutional muster\u201d to the Majority.\u00a0\u00a0They fell back on the Tenth Amendment:<\/p>\n\n\n\n

\u201cThe powers not delegated to<\/em> <\/em>the United States<\/em> <\/em>by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.\u201d<\/em><\/p>\n\n\n\n

But Congress still has \u201cthe power\u201d to enact national legislation.\u00a0\u00a0A Democratic majority of the House of Representatives and of the Senate already agree that the basis of the\u00a0Roe\u00a0<\/em>decision should be made into national law.\u00a0\u00a0But the arcane filibuster rule of the Senate, requiring sixty votes to pass most legislation, has stopped that bill from reaching the President\u2019s desk for signature into law.\u00a0\u00a0<\/p>\n\n\n\n

Mid-Terms<\/h3>\n\n\n\n

Which, of course, makes the upcoming mid-term elections all the more important.  If Democrats retain control of the House and gain two more Senators willing to change the filibuster rule, at least for this issue (and voting rights), then the doctrine of Roe can be written in national law.  But elections have consequences.  Should Republicans gain control of the House or Senate, then obviously that chance to \u201cright the wrong\u201d of Dodds <\/em>won\u2019t happen.  <\/p>\n\n\n\n

The\u00a0Dodds\u00a0<\/em>decision seems to be electrifying the voting public.\u00a0\u00a0 New voter registration for women is out-distancing men\u2019s by several percent.\u00a0\u00a0In \u201cRed \u2013 Red\u201d Kansas, an August state constitutional amendment to allow for banning abortion drew as big an election turnout as the Presidential election of 2012.\u00a0\u00a0By a 59% to 41% margin, the amendment was rejected.\u00a0\u00a0Democrats are looking for that kind of turnout throughout the nation, hoping to turn an expected \u201cRed Wave\u201d into a Blue one.<\/p>\n\n\n\n

Even if Republicans were to take both Houses of Congress, the President would maintain his veto power over legislation.  And no \u201cfever dream\u201d sees this narrowly divided nation electing a two-thirds majority of either House to override a Biden veto.  But that hasn\u2019t stopped Republicans from imagining ways to create a national abortion ban.  <\/p>\n\n\n\n

Old Lindsey<\/h3>\n\n\n\n

Lindsey Graham, Senator from South Carolina, recognizes the drastic impact\u00a0Dodds\u00a0<\/em>may have on voting turnout and November’s results. \u00a0So he\u2019s offered up an \u201colive branch\u201d, a proposal for a new national law.\u00a0\u00a0His proposal:<\/p>\n\n\n\n

\u201cI think we should have<\/em> <\/em>a law at the federal level that would say, after 15 weeks, no abortion on demand except in cases of rape, incest or to save the life of the mother\u2026\u201d(WAPO<\/a>).<\/em><\/p>\n\n\n\n

You can see his thinking.\u00a0\u00a0Allow fifteen weeks of \u201cchoice\u201d, then exceptions afterwards for rape and incest.\u00a0\u00a0That \u201ccompromise\u201d would allow pro-choice Republicans\u00a0\u00a0like those in Kansas, to stay with their Party instead of crossing over to vote for \u201cpro-choice\u201d Democrats.\u00a0\u00a0It\u2019s an \u201colive branch\u201d of compromise, or so he says.\u00a0\u00a0His problem; so much of his own Party is committed to absolute abortion bans. It\u2019s problematic that he could garner even his own Republican support.<\/p>\n\n\n\n

And the \u201colive branch\u201d is more of a \u201cwhip\u201d in the end.\u00a0\u00a0It continues to recognize\u00a0Dodd,\u00a0<\/em>allowing states to make more restrictive abortion laws on their own.\u00a0\u00a0In fact, what the Graham proposal would do is restrict those states that allow abortions, including Kansas, New York, and California, to his proposed Congressional standard. It would leave the others with almost total bans alone.\u00a0\u00a0And it tears down the veneer of \u201cTenth Amendment\u201d, and shows the real Republican view of women\u2019s rights.\u00a0\u00a0Lindsey Graham, Justice Samuel Alito and the rest want to be the \u201cwhip hand\u201d, holding the reins and driving the country back into the last century, stroke by stroke.<\/p>\n","protected":false},"excerpt":{"rendered":"
