{"id":5646,"date":"2022-06-21T07:52:53","date_gmt":"2022-06-21T11:52:53","guid":{"rendered":"https:\/\/dahlman.online\/?p=5646"},"modified":"2023-07-13T11:23:58","modified_gmt":"2023-07-13T15:23:58","slug":"one-person-no-vote","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2022\/06\/21\/one-person-no-vote\/","title":{"rendered":"One Person, No Vote"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Three-Fifths<\/h3>\n\n\n\n<p>America has a history of unbalanced voting rights.\u00a0\u00a0In the beginning, most of the states the Founding Fathers represented counted every person. But only  white men, over the age of twenty-one, who owned property; were actually allowed to vote.\u00a0\u00a0<\/p>\n\n\n\n<p>Voting imbalance was enshrined in the US Constitution, through the infamous Three-Fifths Compromise.\u00a0\u00a0How many representatives a state would get in the House of Representatives (and the Electoral College) was determined by adding to,\u00a0<em>\u201c\u2026the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other persons.\u201d<\/em>\u00a0\u00a0 Those three-fifths were the enslaved people, Black people.\u00a0\u00a0They were \u201cgood enough\u201d to partially count for the purpose of determining representation and taxation.\u00a0\u00a0But they certainly didn\u2019t have the right to vote.<\/p>\n\n\n\n<p>Like Jefferson\u2019s famous \u201cAll Men are created equal\u201d, the right to vote was carefully apportioned among the privileged.&nbsp;&nbsp;&nbsp;It took a Civil War and almost one hundred and eighty years of history to reach a point where, at least theoretically, every citizen could vote.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Constitutional Inequality<\/h3>\n\n\n\n<p>But even then, everyone\u2019s vote is not \u201cequal\u201d.\u00a0\u00a0There are Constitutional inequities:\u00a0\u00a0each state, no matter its population size, has two Senators.\u00a0\u00a0Because of that, smaller states citizens are \u201cweighted\u201d in the Senate and the Electoral College.\u00a0\u00a0A citizen\u2019s vote for President in Ohio is one in about 700,000 per Elector in the College.\u00a0\u00a0A citizens vote in Wyoming is almost four times more \u201cpowerful\u201d, one in 172,000.\u00a0\u00a0Folks in Wyoming have \u201cmore say\u201d, but states like California, Texas, New York and Florida obviously have more total votes.\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p>Wyoming\u2019s population, with its two Senators and three Electoral Votes, is the population of the Youngstown-Warren metro area here in Ohio.\u00a0\u00a0When you see giant \u201cred and blue\u201d maps of how counties voted for President, the United States looks overwhelmingly \u201cred\u201d.\u00a0\u00a0But land doesn\u2019t vote, people do.\u00a0\u00a0American votes are amassed in urban areas, many on the East and West Coasts.\u00a0\u00a0Check out the population based maps, rather than the geographic ones.\u00a0\u00a0America is a lot \u201cbluer\u201d that way (see the maps in this essay from 2019,\u00a0<em><a href=\"https:\/\/dahlman.online\/index.php\/2019\/12\/24\/sleeping-serpents\/\">Sleeping Serpents<\/a>).<\/em><\/p>\n\n\n\n<p>Though the middle of the twentieth century, some states modeled the US Constitution in their own state legislatures.\u00a0\u00a0State House of Representative districts, like the US House, were divided equally by population.\u00a0\u00a0But State Senate seats were divided into \u201chistoric\u201d districts, and like the US Senate.  Many were \u201cunbalanced\u201d in population.\u00a0\u00a0It wasn\u2019t until 1964, the year of the Civil Rights Act,  that the US Supreme Court applied  \u201cone person, one vote\u201d. That case, <em>Reynolds v Sims<\/em>,  ruled for all offices, except the Constitutional ones<em>.\u00a0<\/em>For<em>\u00a0<\/em>every state elected office, each vote must count equally.\u00a0The Court upheld that principle 9-0 as late as the 2016 case\u00a0<em>Evenwel v Abbott.<\/em> <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Who Gets to Choose<\/h3>\n\n\n\n<p>In every state in the Union, the voters choose their elected public officials.\u00a0\u00a0But now, in 2022, a year and a half after the Insurrection, the Texas Republican Party has a new proposal. As passed in their Houston convention last week, they said:<\/p>\n\n\n\n<p><em>\u201cThe State Legislature shall cause to be enacted a State Constitutional Amendment creating an electoral college consisting of electors selected by the popular votes cast within each individual state senatorial district, who shall then elect all statewide office holders.\u201d<\/em><\/p>\n\n\n\n<p>Why would they choose a \u201cstate\u201d electoral college?\u00a0\u00a0And it\u2019s not just to select the Governor and Lieutenant Governor. There are twenty-seven statewide elected officials in Texas, including the entire Supreme Court and Criminal Appellate Courts.\u00a0\u00a0<\/p>\n\n\n\n<p>There are thirty-one State Senate districts in Texas, carefully \u201cdrawn\u201d (Gerrymandered) to provide an 18 to 13 Republican majority in the Senate.\u00a0\u00a0Texas election results in 2020 were 52% Republican and 46<em>%\u00a0<\/em>Democrat \u2013 a 16 to 15 split if the Senate was drawn fairly.\u00a0\u00a0Now the Republicans in Texas want to \u201camplify\u201d the power of that Gerrymandering, by creating a State Electoral College, to make sure that every statewide office remains in Republican hands.\u00a0\u00a0There would be no chance that a Beto O\u2019Rourke or Julian Castro might slip in on a statewide majority of Democratic votes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Extreme is Normal<\/h3>\n\n\n\n<p>We might say that the State Republican Convention in Texas is extreme.&nbsp;&nbsp;They are against homosexuality (\u201can abnormal lifestyle\u201d), reject the outcome of the election of 2020 (Biden an illegitimate President), and raising the age to buy an assault rifle to twenty-one (they might need them in a hurry to protect from a riot).&nbsp;&nbsp;But with an extreme United States Supreme Court, that continues to allow the Texas \u201cPlan\u201d of enforcing abortion bans through civil suits rather than state action, who knows what actually could become \u201claw\u201d?<\/p>\n\n\n\n<p>The Texas Republican legislature is even debating a resolution to ignore any Federal law they don\u2019t like. That&#8217;s in spite of the fact that the US Constitution says Federal law is supreme, and the concept of \u201cnullification\u201d, popular in the early years of the United States, died a bloody death in the Civil War.<\/p>\n\n\n\n<p>One person, one vote wouldn\u2019t matter then in Texas, at least as far as choosing their state officials are concerned.&nbsp;&nbsp;The will of a majority of Texans might not matter either.&nbsp;&nbsp;And Republicans would have at least a decade-long lock on power in the state,&nbsp;&nbsp;majority or not.<\/p>\n\n\n\n<p>It\u2019s the 2020\u2019s \u2013 whatever you thought was \u201cAmerica\u201d, you better believe your \u201clying\u201d eyes now.&nbsp;&nbsp;Don\u2019t count Texas Republicans out \u2013 they may disenfranchise near half their voters.&nbsp;&nbsp;And the US Supreme Court might let them.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Three-Fifths America has a history of unbalanced voting rights.\u00a0\u00a0In the beginning, most of the states the Founding Fathers represented counted every person.
