{"id":5421,"date":"2022-03-13T08:22:54","date_gmt":"2022-03-13T12:22:54","guid":{"rendered":"https:\/\/dahlman.online\/?p=5421"},"modified":"2022-03-13T08:23:22","modified_gmt":"2022-03-13T12:23:22","slug":"et-tu-ohio-2","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2022\/03\/13\/et-tu-ohio-2\/","title":{"rendered":"Et Tu, Ohio"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Don\u2019t Say Gay<\/h3>\n\n\n\n<p>The big headlines aren\u2019t from Ohio.\u00a0\u00a0Florida is passing legislation  to ban teachers from talking about sexual orientation issues to students, particularly primary grade kids.\u00a0\u00a0That might seem like it makes sense \u2013 primary grade kids aren\u2019t usually sexually aware, even in this digital age.\u00a0\u00a0But it\u2019s an insidious way of \u201cteaching\u201d little kids &#8220;right and wrong, good and bad&#8221;.\u00a0\u00a0Little Bobby can talk all he wants about Mommy and Daddy with the teacher, but Johnny can\u2019t talk about his two Mommies, or Jenny about her two Daddies.\u00a0\u00a0<\/p>\n\n\n\n<p>Kids are intensely aware of what the adults in their lives say, and don\u2019t say.\u00a0\u00a0The fact that one of the most influential adults in their lives, the teacher, will talk with  kids whose parents are two genders, but not kids with parents of one, won\u2019t \u201cget by\u201d them.\u00a0\u00a0And if teacher won\u2019t talk about it, then there must be something wrong, bad, about it.\u00a0\u00a0The silence will deliver the message.<\/p>\n\n\n\n<p>The opposition to the bill calls it the \u201cDon\u2019t Say Gay\u201d bill, and that\u2019s what teachers may be forced to do.\u00a0\u00a0Much like the Texas anti-abortion legislation, the \u201cDon\u2019t Say Gay\u201d bill doesn\u2019t create criminal penalties.\u00a0\u00a0But it invites parents to file lawsuits against teachers who \u201cviolate\u201d the law.\u00a0\u00a0A teacher who does discuss Johnny\u2019s two Mommies could be sued by any  parent in the class.\u00a0\u00a0The law makes that teacher liable for damages.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Texas History<\/h3>\n\n\n\n<p>Texas has already passed a law costing over $14 million a year, to \u201ctrain\u201d teachers how to discuss \u201ccontroversial\u201d issues \u2013 making sure that they present \u201call sides\u201d of such \u201ccontroversies\u201d as the Holocaust, the Civil Rights Movement, or even slavery.&nbsp;&nbsp;And if a teacher is \u201cuncomfortable\u201d, then by law,&nbsp;\u201c\u2026(the) teacher may not be compelled to discuss a widely debated and currently controversial issue of public policy or social affairs (<a href=\"https:\/\/www.texastribune.org\/2021\/12\/02\/texas-critical-race-theory-law\/\">Texas Trib<\/a>)\u201d.&nbsp;<\/p>\n\n\n\n<p>&nbsp;Looks like no more history discussions in Texas.<\/p>\n\n\n\n<p>You might think that Ohio is \u201cabove\u201d this wave of crazy restrictive legislation.\u00a0\u00a0After all, Ohio has a fully Republican legislature, state executive and judicial branch, yet the Supreme Court is ruling against the Republican gerrymandering plans \u2013 multiple times.\u00a0\u00a0\u00a0And while Ohio does have an anti-abortion bill \u201con tap\u201d should the US Supreme Court overrule Roe v Wade and Casey, the state legislature hasn\u2019t gone \u201cwild\u201d like Texas or Missouri and tried to double jump the current Roe holding and ban abortion.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">HB 327<\/h3>\n\n\n\n<p><a href=\"https:\/\/search-prod.lis.state.oh.us\/solarapi\/v1\/general_assembly_134\/bills\/hb327\/IN\/00\/hb327_00_IN?format=pdf\">Ohio House Bill Number 327<\/a> is twenty-one pages long.&nbsp;&nbsp;Most of the bill deals with the recognition of private charter schools and state education funding, an issue which drives public school advocates crazy.&nbsp;&nbsp;But that\u2019s not what the \u201ccontroversy\u201d of HB 327 is about.&nbsp;&nbsp;It\u2019s in the first four pages.<\/p>\n\n\n\n<p>The short title is:&nbsp;&nbsp;\u201cA Bill to amend\u2026the Revised Code to prohibit school districts, community schools, STEM schools and state agencies from teaching, advocating, or promoting divisive concepts\u201d.&nbsp;<\/p>\n\n\n\n<p>What\u2019s a divisive concept, here in the Buckeye state?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Divisive Concept Definitions<\/h3>\n\n\n\n<ul class=\"wp-block-list\" style=\"font-size:14px\"><li>That one group is inherently superior to another*<\/li><li>That the US is fundamentally racist or sexist<\/li><li>That one person, by belonging to a group, is consciously or unconsciously racist*<\/li><li>An individual should be discriminated against or receive adverse treatment because of their group*<\/li><li>Members of one group cannot and should not attempt to treat others without respect to their group*<\/li><li>An individual\u2019s moral character is determined by their group membership*<\/li><li>An individual, by virtue of their group, is responsible for actions committed in the past by other members of their group*<\/li><li>That meritocracy or a hard work ethic are racist or sexist or created by one group to oppress another group*<\/li><li>Any form of race or sex stereotyping or any other form of race or sex scapegoating<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\" style=\"font-size:14px\"><li>*group means \u201cnationality, color, ethnicity, race or sex.<\/li><\/ul>\n\n\n\n<p>And if a school district teaches one of these \u201cdivisive\u201d concepts?\u00a0\u00a0Then the Department of Education will withhold part of their state funding until they stop.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In the Classroom<\/h3>\n\n\n\n<p>I was a Social Studies teacher, living and working in a suburban school district.&nbsp;&nbsp;Our district was largely white, middle class, and Christian.&nbsp;&nbsp;As an eighth grade history teacher \u2013 I taught about enslavement, the Holocaust, women\u2019s suffrage, the civil rights movement, and the equal rights movement.&nbsp;&nbsp;&nbsp;All of those are \u201cdivisive\u201d issues.&nbsp;&nbsp;Can today\u2019s teacher still teach them?<\/p>\n\n\n\n<p>Well \u2013 sort of.&nbsp;&nbsp;<\/p>\n\n\n\n<p>It\u2019s OK (section D of the bill says so) to discuss \u201cdivisive\u201d concepts in an objective manner \u201cwithout endorsement\u201d.\u00a0\u00a0And it\u2019s OK to have an \u201cimpartial\u201d discussion of controversial aspects of history.\u00a0\u00a0And finally, it\u2019s OK to give \u201cimpartial\u201d instruction of historical oppression of a particular \u201cgroup\u201d.\u00a0<\/p>\n\n\n\n<p>Oh, and it\u2019s all right to talk about national motto, national anthem, the Ohio Constitution, the US Constitution, the Revised Code, Federal Law, and US Supreme Court decisions.\u00a0\u00a0Those are the ones listed \u2013 I wonder how much trouble the Emancipation Proclamation might create?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How Impartial<\/h3>\n\n\n\n<p>So when I taught about the Three Fifth\u2019s Compromise in the Constitution, would I need to be \u201cimpartial\u201d about the fact it counted slaves as a fraction of a person for the purpose of how many seats in Congress a state received, but not for voting?\u00a0\u00a0Am I supposed to take James Madison avowed view; that recognizing them as a fraction was better than not recognizing enslaved people as humans at all?\u00a0\u00a0Is that \u201cimpartial\u201d enough?<\/p>\n\n\n\n<p>Impartiality is in the eye of the beholder.&nbsp;&nbsp;That first year of eighth grade history, I had a Holocaust denier in class.&nbsp;&nbsp;I soon realized that most of my students only had a vague understanding of what the Holocaust was, (or American enslavement, or the Indian removal).&nbsp;&nbsp;So I took some extra class time to give them more than just a casual understanding of those events. I wanted them to understand that while there\u2019s lots of good in the world, there\u2019s lots of evil as well.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Was I being impartial while teaching historic inhumanity?&nbsp;&nbsp;&nbsp;Oh Hell no.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">More Perfect<\/h3>\n\n\n\n<p>&nbsp;The United States was founded by flawed men.&nbsp;&nbsp;Many of them didn\u2019t recognize an entire race as being completely human.&nbsp;&nbsp;The Declaration\u2019s \u201c\u2026all men are created equal\u201d was a very limited concept (and it\u2019s not on the list anyway).&nbsp;&nbsp;And they didn\u2019t believe women were \u201cequal\u201d either. I believe in American Exceptionalism \u2013 but America is a nation flawed from its inception.&nbsp;&nbsp;What makes America exceptional is its growth, overcoming the flaws that were there in the beginning, and some that are still here today.&nbsp;&nbsp;As Madison himself wrote:&nbsp;&nbsp;\u201cWe the People of the United States, in order to form a MORE perfect union\u2026\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>It is in the act of becoming \u201cMore Perfect\u201d that America is exceptional.&nbsp;&nbsp;&nbsp;But that\u2019s probably \u201cdivisive\u201d \u2013 and shouldn\u2019t be taught.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">It Doesn&#8217;t Have to Pass<\/h3>\n\n\n\n<p>HB 327 isn\u2019t a law \u2013 yet.\u00a0\u00a0And the language is so convoluted that it\u2019s hard to see how it will be enforced.\u00a0\u00a0But that\u2019s not really the point, is it.\u00a0\u00a0HB 327 up for debate and vote for two reasons.\u00a0\u00a0First, it fits in with the current political \u201ctrend\u201d, erroneously called Critical Race Theory.\u00a0\u00a0One political party has found this \u201cwedge\u201d issue to drive their voters to the polls \u2013 and this legislation is all of that.\u00a0\u00a0<\/p>\n\n\n\n<p>And second, whether 327 becomes law or not, it is part of the larger message to teachers and students:\u00a0\u00a0don\u2019t question the \u201cstandard\u201d lesson, don\u2019t challenge students to think \u201coutside the box\u201d.\u00a0\u00a0It might be divisive, make students uncomfortable, and it might cost the teachers their jobs.\u00a0\u00a0A vocal minority wish to silence teachers.\u00a0\u00a0They want to go back to the history books of the 1950\u2019s, when the Civil War was a dispute over states\u2019 rights, not slavery, and all of the heroes were white men.
