{"id":4379,"date":"2021-06-24T10:57:26","date_gmt":"2021-06-24T14:57:26","guid":{"rendered":"https:\/\/dahlman.online\/?p=4379"},"modified":"2021-06-24T10:57:31","modified_gmt":"2021-06-24T14:57:31","slug":"message-from-on-high","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2021\/06\/24\/message-from-on-high\/","title":{"rendered":"Message from on High"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Dean of Students<\/h3>\n\n\n\n<p>Hey old friends, fellow Deans of Students maintaining discipline in public high schools:&nbsp;&nbsp;the United States Supreme Court is talking to you.&nbsp;&nbsp;They are talking about the absolute bane of your existence \u2013 social media.&nbsp;&nbsp;I remember:&nbsp;&nbsp;sitting in the office, looking at screenshots and seeing&nbsp;&nbsp;the often profane and explicit messages from one student to another. I tried to find some way to \u201cmake it right\u201d for the student attacked, and for the parents who were unable to protect their child.<\/p>\n\n\n\n<p>What school rule applied?&nbsp;&nbsp;Do you suspend a kid for writing on social media on their personal phone in terms that you surely would \u201cboot them\u201d for if they said it out loud in the cafeteria?&nbsp;&nbsp;How did the school become the social media \u201cpolice\u201d, and where did we gain the expertise or the authority to make those decisions?&nbsp;&nbsp;And finally, while you see what\u2019s in front of you \u2013 what are you missing that you can\u2019t see?&nbsp;&nbsp;Where is the entire \u201cmessage chain\u201d?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Facebook Era<\/h3>\n\n\n\n<p>It was easier when I sat in that chair (with school purchasing, probably the same one).&nbsp;&nbsp;That was the \u201cFacebook Era\u201d \u2013 the only \u201csocial media\u201d that mattered.&nbsp;&nbsp;Facebook wasn\u2019t really ready for any of this, the tools to block or hide posts were clumsy and difficult to use.&nbsp;&nbsp;As \u201cthe Dean\u201d, I had a \u201cdummy\u201d account, one not directly connected to my personal accounts, that could be used for \u201cinvestigations\u201d.&nbsp;&nbsp;It was originally for threats; an outgrowth of the Columbine violence.&nbsp;&nbsp;We had to know what was going on out there.&nbsp;&nbsp;No school wanted to have a joke like \u201cthe trench coat mafia\u201d in last year\u2019s yearbook turnout out to be the terrorists in this year\u2019s library (that happened at Columbine).&nbsp;&nbsp;<\/p>\n\n\n\n<p>But that \u201cdummy\u201d account opened a whole new world of potential problems.&nbsp;&nbsp;Sure we caught the rumors of kids bringing weapons to school.&nbsp;&nbsp;We could intervene early, before some kid took action, before he (almost always a he) had a chance to do something irrevocable.&nbsp;&nbsp;But we also were flooded with bullying, blackmail, and hate that used to be whispered conversations on the back of the bus.&nbsp;&nbsp;Now it was public, often without attribution, and permanently saved in the cyberworld.&nbsp;&nbsp;Do we act on it all?&nbsp;&nbsp;Could we act on words typed in the middle of the night, in a kid\u2019s bedroom?&nbsp;&nbsp;How far did \u201cdisruption of the educational process\u201d&nbsp;&nbsp;go?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Tinker<\/h3>\n\n\n\n<p>\u201cDisruption of the educational process\u201d is a term of art.\u00a0\u00a0It\u2019s the language of the Supreme Court in\u00a0<em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/393\/503\/#tab-opinion-1947775\">Tinker versus Des Moines<\/a><\/em>, the foundational case dealing with students and their freedom of speech.\u00a0\u00a0Essentially,\u00a0<em>Tinker\u00a0<\/em>guarantees students the freedom to express themselves, as long as that expression doesn\u2019t disrupt the \u201ceducational process\u201d, the primary task of public education.\u00a0\u00a0<em>Tinker\u00a0<\/em>stated that schools have an educational duty to allow students freedom of expression as an \u201c\u2026important part of the educational process\u201d.\u00a0\u00a0<\/p>\n\n\n\n<p>The balance is between \u201cdisruption of the educational process\u201d and the limits of \u201cin loco parentis\u201d (the school\u2019s authority in place of parents).&nbsp;&nbsp;Mom or Dad can confiscate a phone, or punish their child at their discretion.&nbsp;&nbsp;But schools have to meet a higher standard to take disciplinary action for \u201cspeech\u201d.&nbsp;&nbsp;And that standard is based on whether the \u201cspeech\u201d disrupts the school from achieving its primary goal \u2013 education.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pizza Hut<\/h3>\n\n\n\n<p>When I was teaching back in the 1980\u2019s, I used to raise the \u201cPizza Hut\u201d question to my government classes.&nbsp;&nbsp;If a school team went to Pizza Hut and had a food fight \u2013 of course it was the school\u2019s problem.&nbsp;&nbsp;The school was directly in loco parentis.&nbsp;&nbsp;But if some seniors went to Pizza Hut after the game and had the same kind of fight \u2013 was that still the school\u2019s problem?&nbsp;&nbsp;What if it was \u201cour\u201d kids and another school\u2019s kids?&nbsp;&nbsp;&nbsp;A food fight isn\u2019t \u201cfree speech\u201d, and as long as it doesn\u2019t happen in the school cafeteria, it isn\u2019t disrupting the \u201ceducational process\u201d.&nbsp;&nbsp;So where do we draw the line?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mahoney<\/h3>\n\n\n\n<p>The Supreme Court gave us some guidance yesterday.&nbsp;&nbsp;In&nbsp;<em>Mahoney Local School District v BL,&nbsp;<\/em>a student, BL, failed to make the varsity cheer squad.&nbsp;&nbsp;On her personal phone from a local store over the weekend, she posted on Snap Chat making profane comments about the cheer squad and took a picture giving \u201cthe finger\u201d.&nbsp;&nbsp;Snap Chat posts go to a limited number of friends, and are supposed to \u201cdisappear\u201d.&nbsp;&nbsp;But other cheer squad members took \u201cscreen shots\u201d of her comments, and brought them to the attention of school authorities.&nbsp;&nbsp;The school suspended the BL from the junior varsity cheer squad for the remainder of the year.<\/p>\n\n\n\n<p>There were no threats, personal or otherwise, to the cheer squad members or coaches.&nbsp;&nbsp;BL was simply expressing her dissatisfaction at not making varsity, as thousands of kids have done for decades or more.&nbsp;&nbsp;The difference:&nbsp;&nbsp;it was on social media.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What If?<\/h3>\n\n\n\n<p>Had BL walked into the cheer coach\u2019s office and used the profanity and the hand signal, then clearly the school could (and should) discipline her.\u00a0\u00a0If she was in her bedroom talking to a friend and did the same thing, then clearly it would NOT be the school\u2019s concern.\u00a0\u00a0But putting something on social media ultimately made it \u201cpublic\u201d.\u00a0\u00a0Her posts became the topic of discussion for ten minutes in Algebra class.\u00a0\u00a0\u00a0School authorities felt it threatened the cohesive of the cheer squad.\u00a0\u00a0That was enough for them to feel they should take action.<\/p>\n\n\n\n<p>But the Supreme Court said the school was wrong.&nbsp;&nbsp;The majority opinion made three points.&nbsp;&nbsp;The first \u2013 it was off-campus, and therefore the school had less authority \u201cin loco parentis\u201d.&nbsp;&nbsp;The second \u2013 the school does not have authority over student speech twenty-four hours a day, seven days a week.&nbsp;<\/p>\n\n\n\n<p>And in the third&nbsp;&nbsp;and most important point \u2013 the decision said:&nbsp;&nbsp;<em>\u201c\u2026the school itself has an interest in protecting a student\u2019s unpopular expression, especially when the expression takes place off campus, because America\u2019s public schools are the nurseries of democracy\u201d.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Teaching Free Speech<\/h3>\n\n\n\n<p>The Court ruled that BL had the freedom of speech to say what she said, where and when she said it, on Snap Chat.&nbsp;&nbsp;They ruled the school didn\u2019t have authority over her at that time.&nbsp;&nbsp;And, in fact, the Court ruled the school needed to protect her right to say those things, as an educational exercise in democracy.<\/p>\n\n\n\n<p>So Dean, where does that leave you now?\u00a0\u00a0If BL had threatened the Cheer Coach, you could still discipline her.\u00a0\u00a0But what about the next BL, who makes racist statements on her \u201cchat\u201d.\u00a0\u00a0Is that also protected \u2013 or does it threaten the cohesion of the multi-racial cheer team enough to allow for disciplinary action?\u00a0\u00a0And what about that all-encompassing phrase in all our student manuals:\u00a0\u00a0actions \u201cun-becoming\u201d of a co-curricular participant.\u00a0\u00a0The Court didn\u2019t answer that \u2013 so you\u2019ll still have to do what you think is right.\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p>Glad I\u2019m in my \u201coffice chair\u201d &#8212; at
