{"id":3686,"date":"2020-12-11T10:37:02","date_gmt":"2020-12-11T15:37:02","guid":{"rendered":"https:\/\/dahlman.online\/?p=3686"},"modified":"2020-12-11T10:37:12","modified_gmt":"2020-12-11T15:37:12","slug":"18-us-code","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2020\/12\/11\/18-us-code\/","title":{"rendered":"18 US Code"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"175\" height=\"131\" data-attachment-id=\"3687\" data-permalink=\"https:\/\/dahlman.online\/index.php\/2020\/12\/11\/18-us-code\/175px-edmund_ruffin_photo_at_fort_sumter_sc_img_4532\/\" data-orig-file=\"https:\/\/i0.wp.com\/dahlman.online\/wp-content\/uploads\/2020\/12\/175px-Edmund_Ruffin_photo_at_Fort_Sumter_SC_IMG_4532.jpg?fit=175%2C131&amp;ssl=1\" data-orig-size=\"175,131\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"175px-Edmund_Ruffin_photo_at_Fort_Sumter_SC_IMG_4532\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/dahlman.online\/wp-content\/uploads\/2020\/12\/175px-Edmund_Ruffin_photo_at_Fort_Sumter_SC_IMG_4532.jpg?fit=175%2C131&amp;ssl=1\" src=\"https:\/\/i0.wp.com\/dahlman.online\/wp-content\/uploads\/2020\/12\/175px-Edmund_Ruffin_photo_at_Fort_Sumter_SC_IMG_4532.jpg?resize=175%2C131&#038;ssl=1\" alt=\"\" class=\"wp-image-3687\"\/><figcaption>Edmund Ruffin<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Names of Treason<\/h3>\n\n\n\n<p>They are names from the deepest, darkest parts of American History.\u00a0\u00a0The words are used to describe the acts of John Brown and Edmund Ruffin, Benedict Arnold and Aaron Burr.\u00a0\u00a0They are defined by the US Law and codified in 18 US Code \u00a72381-2385.\u00a0\u00a0\u00a0And you hear them tossed about today:\u00a0\u00a0treason, rebellion, sedition and overthrowing the government.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">John Brown<\/h3>\n\n\n\n<p>John Brown and Edmund Ruffin were two sides of the same coin back in the years prior to the Civil War.&nbsp;&nbsp;Brown believed so strongly in abolitionism, that he attacked a United States military armory for weapons to lead a slave uprising.&nbsp;&nbsp;It was a long plotted operation with the goal of creating a nation of freed slaves in the Appalachian Mountains, armed with the weapons of the US Army.<\/p>\n\n\n\n<p>The attack on the Harper\u2019s Ferry armory failed with several killed and Brown himself wounded and captured.\u00a0\u00a0He was tried for murder and treason.\u00a0\u00a0He died at the end of a rope, with his death triggering the final polarization that led to civil war.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Edmund Ruffin<\/h3>\n\n\n\n<p>Edmund Ruffin believed so strongly in the right to own slaves that he was a leading voice in South Carolina to secede from the Union.&nbsp;&nbsp;It was Ruffin who at sixty-seven years of age literally lit the fuse on the American Civil War, by firing the first cannon shot at Fort Sumter in Charleston Harbor.<\/p>\n\n\n\n<p>Too old to fight himself, Ruffin spent a good part of the war avoiding Union capture.\u00a0\u00a0He lost a grandson to the conflict, and when Lee finally surrendered, Ruffin wrapped himself in the Confederate flag, put a rifle in his mouth, and committed suicide.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Benedict Arnold<\/h3>\n\n\n\n<p>Other than Judas Iscariot there is no other named so linked to treason than that of Benedict Arnold\u2019s.&nbsp;&nbsp;A rising General in George Washington\u2019s Revolutionary Army, Arnold plotted with the British to open the Hudson River to British expansion. He would be paid \u00a320,000 and given a commission in the British Army.&nbsp;&nbsp;If he succeeded, the colonies would be split in two, making them easy prey for the Redcoat forces.&nbsp;&nbsp;It was only through Washington\u2019s spies that Arnold was found out before he could act. He escaped the noose, and became a Brigadier General fighting against the Continental Army he once served.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Aaron Burr<\/h3>\n\n\n\n<p>But the \u201ctreason\u201d we should look most closely at today is that of Aaron Burr.&nbsp;&nbsp;We all know the first part of the story.&nbsp;&nbsp;Burr \u201ctook his shot\u201d in the Presidential election of 1800, using the complexity of the American Electoral College system to challenge Thomas Jefferson\u2019s victory.&nbsp;&nbsp;Jefferson was forced to \u201cmake a deal\u201d (\u201cIt might be nice to have Hamilton on your side\u201d) to gain the Presidency.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Burr served as Vice President for four years, but Jefferson made sure the job was only symbolic.&nbsp;&nbsp;And we all know what happened then:&nbsp;&nbsp;the animosity between Burr and Hamilton festered to the point of a duel, and Hamilton was killed.<\/p>\n\n\n\n<p>But that wasn\u2019t Burr\u2019s supposed treason.&nbsp;&nbsp;After the duel, Burr was in danger of prosecution for homicide.&nbsp;&nbsp;He wandered out west, actually spending some time here in Ohio.&nbsp;&nbsp;As he moved down the Ohio River, he gathered a group with the avowed purpose of settling on land in Louisiana, then a part of the newly US acquired Louisiana Purchase.&nbsp;&nbsp;The 40,000 acres would be held by this quasi-military group, and perhaps declare its independence from American control, or even invade Mexico to establish Burr as King.<\/p>\n\n\n\n<p>It wasn\u2019t about ideology.&nbsp;&nbsp;It was about wealth and power, and though Burr\u2019s treason was never proved, his trial marked the end of the political career in the United States.&nbsp;&nbsp;He would spend years in exile in Europe, then come back to his home in New York, a shadowy influence on future politicians until his death in 1836.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Treason<\/h3>\n\n\n\n<p>Treason is a carefully defined term in law (18 US Code \u00a72381).\u00a0\u00a0It requires the treasonous person to \u201c<em>\u2026levy war against (the United States), adhere to their enemies, or give aid and comfort to them<\/em>\u201d.<\/p>\n\n\n\n<p>So what is going on today?&nbsp;&nbsp;Seventeen states, 106 US Congressmen and Senators, and, the current President and Vice President, have the avowed intent to overthrow the results of the 2020 Presidential election.&nbsp;&nbsp;Whatever that action is legally, it is not, in fact, treason.<\/p>\n\n\n\n<p>Misprison of treason (18 US Code \u00a72382) is to have knowledge of, conceal or fail to disclose any action of treason.&nbsp;&nbsp;So if what is going on today isn\u2019t treason, it isn\u2019t \u201cmisprision\u201d of treason either.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Rebellion and Sedition<\/h3>\n\n\n\n<p>Rebellion or insurrection (18 US Code \u00a72383) is incitement of rebellion or insurrection against the authority of the United States of the laws thereof, or giving aid or comfort to those who do.&nbsp;&nbsp;And here\u2019s a case that might be made.&nbsp;&nbsp;Those who advocate throwing out the election of 2020 results are essentially rebelling against the law, and those who \u201cgo along\u201d with them are \u201cgiving aid or comfort\u201d.&nbsp;&nbsp;For 106 US Congressmen and Senators who have joined the Texas lawsuit to overturn the election, they have lent the stature of office to an attempt to subvert the will of the people, and the Federal election laws.<\/p>\n\n\n\n<p>Seditious Conspiracy (18 US Code \u00a72384) states: \u201c<em>if two or more persons\u2026conspire to\u2026oppose by force to prevent hinder or delay the execution of any law of the United States<\/em>\u201d.\u00a0\u00a0The key word is \u201cby force\u201d, and while apparently that hasn\u2019t happened yet, it certainly feels like America is on the verge of\u00a0\u00a0\u201cforce\u201d.\u00a0\u00a0And if it does occur, who will be held accountable for the \u201cconspiracy\u201d?\u00a0\u00a0Will Joe DiGenova, who threatened that the fired head of election security should be \u201cshot, drawn and quartered\u201d, be found guilty?\u00a0\u00a0What about all the others who have called for \u201caction\u201d?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">America Today<\/h3>\n\n\n\n<p>There may be John Browns and Edmund Ruffins out in our nation today; folks who through misguided beliefs and loyalties are willing to commit acts of violence and rebellion.\u00a0\u00a0Our polarized information sources, and our knowingly manipulative leaders are willing and able to take advantage of them.\u00a0\u00a0It\u2019s not those confused ideologues that concern me.\u00a0\u00a0What does is the \u201cAaron Burrs\u201d, our political \u201cleaders\u201d who are taking advantage of the atmosphere they have created for power and money.\u00a0\u00a0<\/p>\n\n\n\n<p>And even worse, I fear the political leaders who can\u2019t find the courage to stand up for American laws and traditions.&nbsp;&nbsp;They are allowing all of this sedition and insurrection to occur, because of the fear of a \u201ctweet\u201d that could end their political career.&nbsp;&nbsp;At least Arnold had the courage to don a Redcoat, and Burr to pull the trigger.<\/p>\n\n\n\n<p>And what should the United States do about all of this?&nbsp;&nbsp;We have now passed the \u201chot potato\u201d to the Supreme Court, where we hope that finally six Republicans will find the courage to stand for the Constitution.&nbsp;&nbsp;As for the rest, 18 US Code \u00a72383 has the perfect remedy:<\/p>\n\n\n\n<p>\u201c<em>\u2026And shall be incapable of holding any office under the United States<\/em>\u201d.\u00a0<\/p>\n\n\n\n<p>If they don\u2019t have the courage to uphold their office, they shouldn\u2019t have it.&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Names of Treason They are names from the deepest, darkest parts of American History.\u00a0\u00a0The words are used to describe the acts of John Brown and Edmund Ruffin, Benedict Arnold and Aaron Burr.\u00a0\u00a0They are defined by the US Law and codified in 18 US Code \u00a72381-2385.\u00a0\u00a0\u00a0And you hear them tossed about today:\u00a0\u00a0treason, rebellion, sedition and overthrowing &hellip;
