True Confession<\/h3>\n\n\n\n

Thursday, Acting White House Chief of Staff Mick Mulvaney hosted the first formal press conference in the White House since last March.  The conference was specifically called to announce the location of next summer\u2019s G7 Summit Meeting:  the Trump owned Doral Hotel in Miami.  <\/p>\n\n\n\n

The President of the United States profiting from holding an international meeting at a property he owns had all sorts of issues.\u00a0\u00a0It directly violated the emoluments clause of the Constitution, and raised a number of questions about the President\u2019s conduct.\u00a0\u00a0The idea was so toxic, even to Republicans, that somewhere in the middle of Saturday evening Trump tweeted that he was dropping the whole thing.\u00a0\u00a0They can go to Camp David as far he is concerned, his least favorite place.\u00a0\u00a0The announcement Thursday though, was really another famous Trump \u201cdistraction;\u201d to change the subject from Syria, Turkey, Ukraine, and impeachment.\u00a0<\/p>\n\n\n\n

And it might have worked.  But Mr. Mulvaney decided this was the time to answer all of the questions the media had for him. So he went ahead and explained exactly what the President did in his actions toward Ukraine.<\/p>\n\n\n\n

The mainstream media was aghast:\u00a0\u00a0Mulvaney openly confessed that Ukrainian military aid funds were held hostage by the White House to force the investigation of Democratic \u201cscandals\u201d there.\u00a0\u00a0Specifically, he said, the funds were held so that the Ukrainian prosecutors would investigate the conspiratorial \u201cCrowdStrike\u201d issue.\u00a0\u00a0\u201cCrowdStrike\u201d is the name for a far-right theory that the US elections were hacked in 2016, not by the Russians, but by Ukrainian supporters of Hillary Clinton.<\/p>\n\n\n\n

Quid Pro Quo<\/h3>\n\n\n\n

Let\u2019s put aside for a moment, the craziness that the President and the White House put any credence in the \u201cCrowdStrike\u201d nonsense.\u00a0\u00a0It was already debunked in the first volume of the Mueller Report. Besides, it makes no sense:\u00a0\u00a0why would Ukraine even \u201cfake\u201d attacking Hillary Clinton\u2019s campaign when it was clear she would be much more supportive of their goals than Donald Trump?\u00a0\u00a0<\/p>\n\n\n\n

It is a violation of American law to ask foreign governments for aid in political campaigns.\u00a0\u00a0That’s exactly what the President did:\u00a0\u00a0even the White House released \u201ccondensed\u201d transcript of the July 25th<\/sup>\u00a0phone conversation with Ukraine\u2019s President Zelensky shows that.\u00a0\u00a0Mr. Trump asked for help about \u201cCrowdStrike\u201d and also about \u201cdirt\u201d on Joe Biden and his son.\u00a0\u00a0It is also a violation of US law to use US funds for personal gain, the \u201cquid pro quo\u201d linking the funds to, \u201c\u2026I need a favor, though,\u201d in the President\u2019s conversation.<\/p>\n\n\n\n

But, in true \u201cTrumpian\u201d style, Mulvaney announced that not only did they demand the Ukrainians investigate Democrats and CrowdStrike, but they were blackmailing them; by holding back the Congressional mandated defense funds.\u00a0\u00a0And Mulvaney said the United States does this all the time, and the media should, \u201c\u2026get over it.\u201d\u00a0\u00a0What was he thinking?<\/p>\n\n\n\n

Your Lying Eyes<\/h3>\n\n\n\n

Later in the evening, the White House put out a statement saying that Mulvaney didn\u2019t say — wait for it — what he said.  It was all \u201cfake news\u201d they said, don\u2019t believe your lying eyes and ears.<\/p>\n\n\n\n

But Mulvaney did say it.  And he went out of his way to do so, this wasn\u2019t a blurted out, accidental confession.  This was a man proud of what his President did, and quite willing to put it out in front of the world.<\/p>\n\n\n\n

The Unitary Executive<\/h3>\n\n\n\n

Richard Nixon once said, \u201c\u2026but when the President does it, that means that it\u2019s not illegal\u201d (Frost Interview<\/a>.)  The current Attorney General, William Barr, has made it clear that in \u201chis\u201d Justice Department the President cannot be indicted for criminal activity while in office.  In addition, they now claim that the President cannot even be investigated (Washington Post<\/a>.)  Their \u201ctheory\u201d of the Presidency, the \u201cunitary executive;\u201d places the President above the law.   The only \u201ccheck\u201d on the power of the President is impeachment and removal.<\/p>\n\n\n\n

So it shouldn\u2019t be a surprise that Chief of Staff Mulvaney came out with an \u201caffirmative defense\u201d of the President, confessing to all of the acts that seem criminal.  They believe that when the President does something,  \u201c\u2026it means that it\u2019s not illegal.\u201d  They also believe that impeachment is restricted to a strict criminal definition of \u201chigh crimes and misdemeanors.\u201d  Put that together:  the President cannot be impeached, because he cannot commit a crime.<\/p>\n\n\n\n

So What<\/h3>\n\n\n\n

And that was Mulvaney\u2019s plan.  It\u2019s the \u201cso what\u201d defense:  so what if the President demanded a \u201cquid pro quo\u201d from Ukraine, so what if he was asking Ukraine for dirt on the Democrats and Biden.  If the President does it, it\u2019s not illegal.  <\/p>\n\n\n\n

And what about the White House issued the \u201cwalk back \u2013 don\u2019t believe your lying eyes\u201d statement later?  It\u2019s all about covering the base. The base got the message from Mulvaney the first time, this President \u201cdoes what he wants.\u201d  Mulvaney\u2019s Freedom Caucus buddies in Congress, Jim Jordan, Mark Meadows, Devin Nunes and the rest can run with that as well.  And for the more established Republicans, they will take heart in the second message.<\/p>\n\n\n\n

 The Chief of Staff has lost his mind.  We all know what\u2019s going to happen.  It\u2019ll be in a tweet next week.  Mick Mulvaney is going back to South Carolina, to spend more time with his wife and triplets, and if he has one, his dog. <\/p>\n\n\n\n

A Higher Purpose <\/h3>\n\n\n\n

Mulvaney served his President.   And he has served his ideology as well.   Mulvaney, in an address to the Federalist Society, said that the balance of power between the Congress and the President is \u201c\u2026out of whack.\u201d  He further stated, \u201c\u2026it\u2019s almost impossible for the executive to be the executive\u201d  (Washington Times<\/a>.)<\/p>\n\n\n\n

Mulvaney, Attorney General Barr, and others are doing their best to \u201cfix\u201d the balance, and protect this renegade President.  It’s all done for a \u201chigher purpose:\u201d <\/p>\n\n\n\n
