{"id":2284,"date":"2019-09-10T10:29:15","date_gmt":"2019-09-10T14:29:15","guid":{"rendered":"https:\/\/dahlman.online\/?p=2284"},"modified":"2019-09-10T10:29:21","modified_gmt":"2019-09-10T14:29:21","slug":"revisiting-the-fourteenth","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2019\/09\/10\/revisiting-the-fourteenth\/","title":{"rendered":"Revisiting the Fourteenth"},"content":{"rendered":"\n<p><em>Article XIV&nbsp;<\/em><\/p>\n\n\n\n<p><em>1:&nbsp;All persons born or naturalized in the United States, and subject to the&nbsp;jurisdiction&nbsp;thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its&nbsp;jurisdiction&nbsp;the equal protection of the laws.<\/em><\/p>\n\n\n\n<p><em>(Amendment 14 &#8211; Rights Guaranteed: Privileges and Immunities of Citizenship, Due Process, and Equal Protection)<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Email from RAN<\/h3>\n\n\n\n<p>I received another email from my conservative \u201cfriends\u201d at the RESPONSE ACTION NETWORK (RAN.)\u00a0\u00a0As usual they needed my help, and money, to help the \u201ceducate\u201d the American public. This time it was about one of their favorite \u201cbogeymen,\u201d what they call \u201cbirthright citizenship.\u201d<\/p>\n\n\n\n<p>So here\u2019s their problem.&nbsp;&nbsp;Any person, born in the territory of the United States of America, is considered a \u201cnatural born\u201d citizen of the United States.&nbsp;&nbsp;They have US citizenship from birth.&nbsp;&nbsp;This includes illegal migrants in Texas, and Russian bimbos that rent Trump apartments in Florida to have their children.&nbsp;And while my RAN friends don\u2019t seem to care much about the Trump bimbos, they really, really hate the migrants in Texas.&nbsp;<\/p>\n\n\n\n<p>So they want to change how citizenship is granted.\u00a0Here&#8217;s the current \u201crules.\u201d<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Be Born in the United States of America<\/li><li>Have one or both US Citizen Parents<\/li><li> Born in a US Commonwealth or Territory<\/li><li>Born \u201cunder the US Flag\u201d on a US flagged ship, plane, embassy or military base.\u00a0<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Black Codes<\/h3>\n\n\n\n<p>These \u201crules\u201d are based on the 14<sup>th<\/sup>Amendment to the US Constitution, written after the Civil War.&nbsp;&nbsp;The original purpose of the Fourteenth was to require the Southern States to treat their former slaves as citizens.&nbsp;&nbsp;Many of the states in the former Confederacy quickly wrote a series of laws called the Black Codes after the War ended.&nbsp;&nbsp;Those Codes created a second level of status for the former slaves, with restrictions on employment, movement, contractual rights and voting rights.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In short, the Black Codes prevented the freedmen from being full citizens.&nbsp;&nbsp;The Republicans (just thought I\u2019d point that out) in Congress wanted Freedmen to have full citizenship rights, and to make sure, they put it in the Constitution.&nbsp;It\u2019s called Black Letter Law:<\/p>\n\n\n\n<p><em>All persons born or naturalized in the United States, and subject to the&nbsp;jurisdiction&nbsp;thereof, are citizens of the United States and of the State wherein they reside.<\/em><\/p>\n\n\n\n<p>All Persons \u2013 regardless of their immigration status, their skin color, their profession or their education, are included in the Fourteenth.\u00a0\u00a0In the United States and subject to the jurisdiction thereof \u2013 within the boundaries of the United States of America, or in areas under its jurisdiction are all included.\u00a0\u00a0Are citizens \u2013 have all the rights of citizenship in the United States and the state where they live.\u00a0\u00a0<\/p>\n\n\n\n<p>Seems pretty cut and dried; if you are born here, you are a citizen here.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Black Letter Law<\/h3>\n\n\n\n<p>Now, my \u201cfriends\u201d at the DIRECT ACTION NETWORK aren\u2019t stupid.&nbsp;&nbsp;They can read, and they know what the Black Letter Law says.&nbsp;&nbsp;And like any good second year law students, they can make an argument, even against the clearest of statutory language.&nbsp;&nbsp;Here\u2019s their assertion.<\/p>\n\n\n\n<p>Illegal migrants have come to the United States in violation of US law,\u00a0\u00a0That makes them not \u201cunder the jurisdiction\u201d of the United States, and they haven\u2019t \u201cearned\u201d the right to be a citizen.\u00a0\u00a0<\/p>\n\n\n\n<p>On the surface, it sounds like a legitimate argument.\u00a0\u00a0Illegal is illegal, right?\u00a0\u00a0But the problem is, that while they may have entered the US in violation of the immigration law, that doesn\u2019t change the \u201call persons\u201d part of the Fourteenth.\u00a0\u00a0The Amendment itself recognizes that their was an \u201cexcepted\u201d class. In the second clause it mentions that \u201cIndians not taxed\u201d would not be counted in the enumeration, census, for the purpose of apportioning legislative seats.\u00a0\u00a0But even, here, those Indians were specifically not excluded from the citizenship clause.<\/p>\n\n\n\n<p>And ask ICE, those illegal migrants are certainly under the jurisdiction of the United States when they are rounded up at the chicken processing plant, or as they drop their children off at school in the morning.&nbsp;&nbsp;So it is more than disingenuous to say they are NOT under US jurisdiction for the purpose of citizenship, but ARE under the jurisdiction for all other legal purposes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Birthers<\/h3>\n\n\n\n<p>The Stephen Miller\/Trump Administration is already trying to alter the citizenship code, changing how children born to Americans overseas are treated as citizens.\u00a0\u00a0Many famous Americans, including Senator John McCain, were born outside of the boundaries of the nation.\u00a0\u00a0McCain was born in the US Canal Zone (Panama), \u201cunder the flag\u201d and of two American parents.\u00a0\u00a0He was considered a \u201cnatural born\u201d citizen, allowing him the opportunity to run for President of the United States (the natural born citizenship status is required.)\u00a0The Administration is proposing  changing how that works.<\/p>\n\n\n\n<p>That was also the whole basis of the \u201cBirther\u201d movement to disqualify Barack Obama.&nbsp;&nbsp;He was in fact born in Hawaii of a Kenyan father and American (Kansas) mother, but the \u201cBirthers\u201d tried to claim that his Hawaiian birth records were forgeries, and that he was actually born in Kenya.<\/p>\n\n\n\n<p>Even if he was (he wasn\u2019t) he still could claim US citizenship through his mother, but that wasn\u2019t the Birther point.\u00a0Trump supporters now claim that the \u201cResistance\u201d is trying to delegitimize the Trump Presidency based on a \u201cstolen\u201d election; the \u201cResistance\u201d learned the tactic from the Birther Movement\u2019s false claims. (By the way, I\u2019m not convinced that the \u201cResistance\u201d isn\u2019t right about the election \u2013 history will tell us in a few years.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">White Citizens<\/h3>\n\n\n\n<p>But, the RAN people demand, what about \u201cAnchor Babies?\u201d&nbsp;&nbsp;These are children, born in the United States, of foreign parents.&nbsp;&nbsp;Since they were born in the territory of the United States of America, they are, in fact, natural born US citizens.&nbsp;&nbsp;Whether their parents stay in the US or not, when those children reach adulthood, they have the right to claim that citizenship.<\/p>\n\n\n\n<p>And that makes the RAN people crazy:\u00a0\u00a0that even more people, particularly \u201cbrown\u201d people, are US citizens.\u00a0\u00a0It is strange though, that the same argument isn\u2019t being made against Europeans, particularly the Russian women who come to Florida, rent a Trump controlled apartment, and give birth.<\/p>\n\n\n\n<p>The RESPONSE ACTION NETWORK\u00a0\u00a0is responding, to the racist citizenship politics of the Trump Administration.\u00a0\u00a0They want to \u201ceducate\u201d Americans on how the Fourteenth Amendment doesn\u2019t really say what it says, just as they are fascinated with ignoring the \u201c\u2026well regulated militia&#8230;\u201d section of the Second Amendment.\u00a0\u00a0<\/p>\n\n\n\n<p>I guess they won\u2019t get my help.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Article XIV&nbsp; 1:&nbsp;All persons born or naturalized in the United States, and subject to the&nbsp;jurisdiction&nbsp;thereof, are citizens of the United States and of the State wherein they reside.
