{"id":1992,"date":"2019-07-08T07:42:17","date_gmt":"2019-07-08T11:42:17","guid":{"rendered":"https:\/\/dahlman.online\/?p=1992"},"modified":"2019-07-08T07:42:22","modified_gmt":"2019-07-08T11:42:22","slug":"open-borders-a-false-choice","status":"publish","type":"post","link":"https:\/\/dahlman.online\/index.php\/2019\/07\/08\/open-borders-a-false-choice\/","title":{"rendered":"Open Borders &#8211; A False Choice"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Open Borders- A False Choice<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Law<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Title 18, \u00a71325. Improper entry by alien<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>(a)\u00a0\u00a0Improper time or place; avoidance of examination or inspection; misrepresentation and concealment of facts<\/em><\/li><li><em>Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.<\/em><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The History<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under Title 18,\u00a71325 of the Federal Code it is misdemeanor crime to cross the US border outside of the legal \u201cports of entry.\u201d\u00a0\u00a0That same section also provides for non-criminal fines that can also be imposed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prior to 1929, it wasn\u2019t a \u201ccrime\u201d to cross the border outside of the ports of entry locations.\u00a0\u00a0 People who illegally entered the United States were still deported, but, they simply weren\u2019t charged with the \u201ccrossing\u201d crime.\u00a0\u00a0They were, legitimately, charged with being illegal \u201cresidents.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reasons for the 1929 law were clearly racist, aimed as much against Asians as Mexicans. It was marginally enforced through the Depression.\u00a0\u00a0Deportations were more likely for illegal residents then, as competition for scarce Depression era employment.\u00a0\u00a0Once World War II began, there was less enforcement as the need for workers increased.\u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Today<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Today the law still remains on the books, defined as a \u201cFirst Degree Misdemeanor.\u201d&nbsp;&nbsp;Both the Obama and Trump Administrations have used this law to take custody of migrants found coming across the border outside of the few \u201cports of entry.\u201d&nbsp;&nbsp;This criminal \u201ccharge\u201d under the Trump Administration has become the justification for detention camps, child separation, and now child detention camps.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The logic the Trump officials argue is this:\u00a0\u00a0migrants crossing outside the ports of entry are breaking the law.\u00a0\u00a0Lawbreakers must be punished, and if we don\u2019t hold them, they might disappear into the US population and avoid punishment.\u00a0\u00a0Therefore we must put them in detention.\u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Castro\u2019s Solution<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It is already illegal to be \u201cunlawfully present\u201d in the United States.  That simply means that someone is in the US without legal permission.\u00a0\u00a0So the difference between \u201cimproper entry\u201d and \u201cunlawful presence\u201d is that a migrant who crosses the border to ask for asylum, a legal right, is not necessarily \u201cunlawfully present.\u201d   They are in fact legally allowed to come in to ask for asylum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, as former Housing Secretary Julian Castro calls for,&nbsp;\u00a71325 was removed, the result then would not be \u201cOpen Borders.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would work this way.\u00a0\u00a0The Border Patrol (getting out of the detention camp guard business and back to what they are supposed to do) would apprehend those crossing the border outside of the ports of entry.\u00a0\u00a0Those with a lawful purpose, seeking asylum, would be processed and released, to return later for their asylum hearings.\u00a0\u00a0When this was done in the past by ignoring \u00a71325; 85 to 90% return to appear at the hearings.\u00a0\u00a0They wanted to be in the United States legally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Others apprehended, smuggling drugs or people or for other reasons, could either be charged with the crimes they committed, or for being \u201cunlawfully present.\u201d\u00a0\u00a0Those would then be held for trial, just like any other criminal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The False Choice<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is not OPEN BORDERS, as the Trump administration has claimed.\u00a0\u00a0They have created a false choice, their detention camps or unregulated access to the United States.\u00a0\u00a0The choice really is, DETENTION CAMPS (or more correctly, concentration camps) or HUMANE TREATMENT and recognition of the legal right to claim asylum under US Law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The benefits:\u00a0\u00a0the United States would no longer be in the \u201cdetention camp\u201d business, and worse, in the child separation business.\u00a0\u00a0The Border Patrol would also not be in violation of Federal Court Order in the Flores Agreement,  that states that they cannot detain children for longer than 72 hours.\u00a0\u00a0And the cost of caring for the migrants would be carried by their relatives already in the US, or the humanitarian agencies along the border, and not by the US Government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The drawbacks:&nbsp;&nbsp;it would require an increase in the number of prosecutors, defense lawyers, and judges to deal with the asylum claims.&nbsp;&nbsp;Currently there is a backlog of close to a million claims nationwide; whether we imprison folks or not, we need to expand our legal system for this issue.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Oh, there\u2019s one more benefit.\u00a0\u00a0We wouldn\u2019t need a \u201cWALL\u201d to stop folks.\u00a0\u00a0We could spend that money more wisely somewhere else, maybe in aid to the Northern Triangle of Central America, where even Republicans agree the migrant crisis begins.\u00a0\u00a0The anticipated WALL cost of $40 billion would go a long way towards changing conditions at the source.
